5 U.S.C. ? 552(a)(7) states, in pertinent part,
Each agency shall .. , provide[ J information about the status of a request to the person
making the request ... , including ... an estimated date on which the agency will
complete action on the request,
Pursuant to this statute, I hereby formally request that the Central Intelligence Agency provide
me with a written estimated date on which the agency will complete action on each of the FOIA
requests listed above. A mere statement of a request's place in your queue will not satisfy this
status request. Similarly, a statement that the agency has a significant backlog of requests and
cannot provide an estimated date of completion will not satisfy this status request. Only "an
estimated date on which the agency will complete action on the request" will satisfy this status
request and the agency's statutory responsibility. For requests that are currently under appellate
review, I request that the agency provide me with an estimated date on which the agency will
complete the appellate review.
If you choose not to comply with this request, please provide specific reasons that the
Central Intelligence Agency is not required to comply with the 5 U.S.C. ? 552(a)(7).
In addition, the italicized requests listed above were originally submitted by other
requesters but subsequently assigned to National Security Counselors on 7 October 2009 and 8
(b)(3)

December 2009. It appears, however, that you have not processed these assignments properly, as
you have sent correspondence to one of the original requesters (re: F-2009-00491, which has
been closed) as recently as 23 December 2009, despite being assigned to us in October. I spoke
with Gina in your office on 29 January 2010 regarding this problem, and she promised to check
on the assignments and get back to me. However, as of this writing, I still have yet to receive
any follow-up correspondence on this issue. Please confirm in writing that these assignments
have been properly processed, the requests are now indexed to National Security Counselors
and/or Kel McClanahan, and all correspondence will be directed to us at our above address.
