SUBJECT: Purchase of Cafeteria Equipment

1. The attached requisition covers a number of items of
cafeteria equipment required by the CIA Reproduction Plant in
2. The Comptroller, by memorandum of 20 December 1951, also
attached, has indicated that sufficient funds are available, and
recommended that the requisition be referred to the General Counsel
for an opinion as to legality of purchases Informally, the
Assistant General Counsel has referred us to Comptroller General
Decision A-33272, Volume 10, Page 140, which deals with the question
of construction of temporary buildings from general appropriations,
to include a cafeteria building. It is doubtful that this decision
is applicable in view of the fact that our proposal is for the
purchase of equipment only and does not in any manner deal with
construction,
could approve the purchase of this equipment in view of the fact that
the Comptroller General's Decision cited does not appear to be
applicable,
