UNITED STATES GOVERNMENT TO FROM SUBJECT: Executive Assistant General Counsel Overseas.Allowances and. Benefits DATE: 23 August 1949 1. Attention is called to the attached memoranda and. Section 5 (b) of Public Law 1100 which authorizes the Director to grant allowances to our overseas personnel 'tin accordance with such regulations as the President may prescribe". This is similar to the language of the Foreign Service Act of 1946. 2. While it is agreed that it is desirable to exercise the authorities of Public Law 110 wherever and as soon as possible, attention is called to the passage, by the House of Representatives; 12 August, of H. R. 5526, a bill which authorizes the President to provide for the performance of certain functions by other officers of the Government. Under this bill, the President is authorized to empower the head of an agency to perform without approval, rati- fications, or other action on the part of the President, any function which is vested in the President by law or which an agency head is required by law to perform only with or subject to the approval, ratification or other action of the President. a 3. H. R. 5526 is presently before the Senate Fxpenditures Committee for consideration and there should. be final Committee action probably within the next., thirty days. 4. It is therefore suggested that you consider the advisability of continuing under the present working arrangements until such time as we can determine whether there will be affirmative Senate action on this bill during,; this session.
