.MEMORANDUM FOR: MR. Houston
SUBJECT : Home Service Transfer Allowance - Certification Required
1. The legislative history of the Foreign Service Act Amendment of
1955 approved April 5, 1955 as P.L. 22 - 84th Congress makes no mention of the
possible requirement for certification of interest as a condition of payment
of the allowance. The 1955 U. S. Cong, and Admin News., Vol. 2., states in part
at page 1870:
"3. Allowances
...Section 10., which amends section 901! paragraph 2., of the
Foreign Service Act., will authorize Foreign Service personnel who
are assigned to the United States for a tour of duty to receive an
allowance to enable them to meet expenses necessary for transfer to
floe,
bAme assignment.At the present time such an allowance is provided
only when employees transfer to new posts in foreign countries., even
though transfers to the United States may be just as costly. This
home service transfer allowance would be paid only :Lo emplo
in the United States between assignments to posts abroad." (Emphasis
supplied).
The Act provides at Section 10(a):
"Section 901(2) of such Act is amended by striking out the phrase
"his post of assignment" at the end of paragraph (ii) of that section
and substituting in lieu thereof the phrase "any post of assignment
abroad or at a post of assignment in the continental United States
between assignments to posts abroad." (Emphasis supplied).
Section 252.11(b) of the Standardized Regulations (Government Civilians.,

"Transfer" means a reassignment that involves travel from a post
in a foreign area...to a post in the continental United States with
an understanding certified to by the Agency and the employee that he
will, upon com letion of such reassignment, again be assigned to
a post abroad.
." In keeping with the foregoing there appears to be no requirement
outside Agency regulation for the dual certification established in
Section I
3. It is recommended that the substance of the following certification
would fulfill the Standardized Regulations (a.C., F.A.) requirement
set forth in paragraph 1, above.
"It is understood that
does not intend to resign, retire, or otherwise separate himself from
CIA during the period of his assignment in the United States and that
upon completion of such assignment, he shall again be assigned to a
post outside the continental United States.
