Approved For Release 2000/08/22 : CIA-RDP59-00224A000100200002-1 84TH CONGRESS 1ST SESSION S. 1351 IN THE SENATE OF THE UNITED STATES MARCH 8, 1955 Mr. IIITMPHREY introduced the following; bill ; which was read twice and referred to the Committee on Finance A BILL To provide a means whereby domestic producers who are in- jured by increased imports resulting from trade agreement concessions may obtain preferences in bidding for Gov- ernment contracts. 1 Be it enacted by the Senate and House of Representa- tives of the United States of America in. Congress assembled, That this Act may be cited as the "Reciprocal Trade Casual- tics Act of 1955". SEC. 2. The first sentence of the third paragraph of sec- tion 7 (a) of the Trade Agreements Extension Act of 1951 (19 U. S. C., sec. 1364 (a)) is hereby amended to read as follows : "Sli ould the Tariff Commission find, as the result of its investigation and hearings, that a product on which a Approved For Release 2000/08/22 : CIA-RDP59-00224A000100200002-1 Approved For Release 2000/08/22 : CIA-RDP59-00224A000100200002-1 '1 concession has been granted is, as a result, in whole or in part, of the duty or other customs treatment reflecting such concession, being imported in such increased quantities, either actual or relative, as to cause or threaten serious injury to the domestic industry producing like or directly com- petitive products, it shall recommend to the President the withdrawal or modification of the concession, its suspension in whole or in part, the granting of Reciprocal Trade Casual- ties Act Certificates, or the establishment of import quotas, to the extent and for the time necessary to prevent or remedy such injury," SEC. 3. The first sentence of section 7 (c) of such Act of 1951 (19 U. S. C., sec. 1364 (c) ) is hereby amended to read as follows : "Upon receipt of the Tariff Commission's report of its investigation and hearings, the President may make such adjustments in the rates of duty, impose such quotas, or make such other ncodifications, or provide for the issuance of such Reciprocal `Trade Casualties Act Certifiu-ates, as are found and' reported by the Commis- sion to be necessary to prevent or remedy serious injury to the respective domestic industry." SIC. 4. Section 7 of such Act of 195j. (19 U. S. C., sec. 1364) is hereby amended by adding at the end thereof the following new subsection : " (e) (1) It is hereby declared to be the purpose of Approved For Release 2000/08/22 : CIA-RDP59-00224A000100200002-1 Approved For Release 2000/08/22 : CIA-RDP59-00224A000100200002-1 3 1 this subsection to foster the economic survival of domestic 2 producers- 3 "(A) who, as a result (in whole or in part) of 4 the duty or other customs treatment reflecting a. con- 5 cession which has been granted under a trade agree- 6 ment, are being seriously injured or threatened with 7 serious injury, and 8 "(B) who take energetic steps to increase produc- 9 tivity or to develop new products, or both. 10 " (2) The President is hereby authorized to provide for 11 the issuance of certificates (which shall be known as "Re- 12 ciprocal Trade Casualties Act Certificates" which shall en- 13 title the holder thereof to a percentage advantage on any 14 bid on any purchase or contract by the United States. In 15 determining the lowest bid on any purchase or contract by 16 the United States, the bid of any domestic producer who 17 holds a Reciprocal Trade Casualties Act Certificate shall 18 be treated as if it were an amount determined by subtracting 19 from the bid price the amount obtained by multiplying the 20 bid price by the percentage advantage to which the pro- 21 ducer is entitled under the certificate. 22 " (3) A Reciprocal Trade Casualties Act Certificate 23 issued to any producer- 24 "(A) shall entitle the producer to such percentage 25 advantage (not to exceed 25 per centum), and Approved For Release 2000/08/22 : CIA-RDP59-00224A000100200002-1 Approved For Release 2000/08/22 : CIA-RDP59-00224A000100200002-1 4 1 " (B) shall be valid for such period (not to exceed 2 three years from the date of issuance or from the date 3 of an,), subsequent renewal) , 4 as is detennined, under regulations prescribed under para- 5 graph (4) , will best carry out the purpose of this sub- 6 section. 7 " (4) The President is authorized to prescribe such 8 regulations as he deems necessary or appropriate to carry 9 out the provisions and purpose of this subsection."
