Approved For Release 2002/01/10 : CIA-RDP59-00224A000100210006-6 25X1A NOTICE OF PENDING LEGISLATION 18 Jmuiuary 1' 56 LEGISLATIVE BILL NO. H. R. 6710 Dix/Lo tice GENERAL FROM: LEGISLATIVE COUNSEL OFFICE OF GENERAL COUNSE _FOLD _ HERE A BILL ON WHICH FAVORABLE CONGRESSIONAL ACTION = IS E7-] IS NOT PREDICTED. SENT FOR YOUR COMMENT AS TO WHETHER IT IS OF INTEREST TO CIA ACTIVITIES. AND WHETHFR FURTHER ACTION BY THIS OFFICE IS NECESSARY OR DESIRED. CIT IS REQUESTED THAT COMMENTS CONCERNING THIS LEGISLATION BE FORWARDED, THROUGH APPROPRIATE CHANNELS, TO THIS OFFICE. BY ____ ___ ___ __._._._? : LEGISLATIVE COUNSEL CO+ENTS (From Original Addreaaee) FFROM:_ 1. The enactment of H.R. 8710 would amend the Armed Services Procurement Act of 1947 in several particulars. While it would increase the scope caf certain negotiation authorities by raising the $1000 limitation contained in Section 2 (c) (3) to $2500 and by permitting the procurement of non-perishable subsistence items as well as perishable under Section 2 (c)(9), it would restrict the authority to procure by negotiation during periods of national emergency under Section 2 (c)(1), to those emergencies declared by the C,)egress. It is this part of the proposal that has some relationship to this Agency. 2. Under the provisions of Section 3(a) of the CIA Act of 1949 th:s Agency has the authorities set forth in Section 2 (c) (1) (2) (3) (41 (5) (6) (10) (12)(15)(17), and Sections 3, 4, 5, 6 and 10 of the Armed Services Procurement Act. Under the present Section 2(c)(1) procurement may be effected by negotiation during a "period of a national emergency declared by the President or the, Congress' H. R. 8710 would strike "ice the President'" 3. The vast majority of Agency procurement is effected under Section 2(c) (10) (impracticable to secure competition) of the Armed Services Proeurea nt Act or Section 10 of the CIA Act. Only in a few isolated cases has recourse een made to Section 2 (c)(1). While the Agency would naturally be reluctant ao have this "reserve authority" as presently contained in Section 2(c)(1) so drac-tically curtailed as is now proposed, in as much as it has been only of minor sigiifieance plus the fact that the Agency would continue to have other authorities which seem to be better suited for its purposes, it would appear that no meritorious objection to the enactment of H.R. 8710 could be presented. 25X1A DATE OF COMMF TS SI EXTENSION _ FORM NO. 488 REPLACES FORM 23.3 (38) I FEB 55 Vv WHICH MAY BE USED.
