1. The enactment of H.R. 8710 would amend the Armed Services Procurement
Act of 1947 in several particulars. While it would increase the scope caf
certain negotiation authorities by raising the $1000 limitation contained in
Section 2 (c) (3) to $2500 and by permitting the procurement of non-perishable
subsistence items as well as perishable under Section 2 (c)(9), it would
restrict the authority to procure by negotiation during periods of national
emergency under Section 2 (c)(1), to those emergencies declared by the C,)egress.
It is this part of the proposal that has some relationship to this Agency.
2. Under the provisions of Section 3(a) of the CIA Act of 1949 th:s
Agency has the authorities set forth in Section 2 (c) (1) (2) (3) (41 (5) (6) (10)
(12)(15)(17), and Sections 3, 4, 5, 6 and 10 of the Armed Services Procurement
Act. Under the present Section 2(c)(1) procurement may be effected by negotiation
during a "period of a national emergency declared by the President or the, Congress'
H. R. 8710 would strike "ice the President'"
3. The vast majority of Agency procurement is effected under Section 2(c)
(10) (impracticable to secure competition) of the Armed Services Proeurea nt Act
or Section 10 of the CIA Act. Only in a few isolated cases has recourse een
made to Section 2 (c)(1). While the Agency would naturally be reluctant ao have
this "reserve authority" as presently contained in Section 2(c)(1) so drac-tically
curtailed as is now proposed, in as much as it has been only of minor sigiifieance
plus the fact that the Agency would continue to have other authorities which
seem to be better suited for its purposes, it would appear that no meritorious
objection to the enactment of H.R. 8710 could be presented.
