Approved For Release 2000/08/25: CIA-RDP59-00224A000100480003-0 84TH CONGRESS 1ST SESSION S. 2569 IN THE SENATE OF THE UNITED STATES JULY 18,1955 Mr. MANSFIELD introduced the following bill ; which was read twice and referred to the Committee on Foreign Relations A BILL To provide certain basic authority for the Department of State. 1 Be it enacted by the Senate and House of Representa- 2 tives of the United States of America in Congress assembled, 3 That the Secretary of State is authorized to establish, inain- 4 taro, and operate passport and despatch agencies. 5 SEC. 2. The Secretary of State, when authorized in an 6 appropriation or other law, may- 7 (a) authorize printing and binding without regard 8 to section 11 of the Act of March 1, 1919 (44 U. S. C. 9 111) ; 10 (b) purchase, rent, operate, and maintain printing 11 and binding machines, equipment, and devices abroad; 12 (c) pay the cost of transportation to and from a Approved For Release 2000/08/25: CIA-RDP59-00224A000100480003-0 Approved For Release 2000/08/25: CIA-RDP59-00224A000100480003-0 2 1 place of storage and the cost of storing the furniture 2 and household and personal effects of an employee of 3 the Foreign Service who is assigned to a post at which 4 he is unable to use his furniture and effects, under such 5 regulations as the Secretary may prescribe; 6 (d) employ aliens, by contract, for services abroad; 7 (e) employ personnel without regard to the civil- 8 service laws and regulations, and the Classification Act 9 of 1949, as amended; 10 (f) furnish official entertainment; 11 (g) purchase uniforms ; and 12 (h) pay the actual expenses of preparing and trans- 13 porting to their former homes the remains of persons, 14 not United States Government employees, who. may die 15 away from their homes while participating in inter- 16 national educational exchange activities under the juris- 1.7 diction of the Department of State. 18 SEC. 3. The Secretary of State is authorized to- 19 (a) obtain insurance on official motor vehicles oper- 20 ated by the Department of State in foreign countries 21 when required by the law of such countries, and pay 22 the expenses incident thereto; 23 (b) rent tie lines and teletype equipment; . 24 (c) provide ice and drinking water for United 25 States Embassies and Consulates abroad; Approved For Release 2000/08/25: CIA-RDP59-00224A000100480003-0 Approved For Release 2000/08/25: CIA-RDP59-00224A000100480003-0 3 (d) pay excise taxes on negotiable instruments 2. which are negotiated by the Department of State abroad; 3 (e) pay expenses incident to the relief, protection, 4 and burial of American seamen, and alien seamen from 5 United States vessels in foreign countries and in the 6 United States Territories and possessions; 7 (f) pay the expenses incurred in the acknowledge- 8 ment of the services of officers and crews of foreign 9 vessels and aircraft in rescuing American seamen, air- 10 men, or citizens from shipwreck or other catastrophe 11 abroad or at sea; 12. (g) rent or lease, for periods of less than ten years, 13 such offices, buildings, grounds, and living quarters for 14 the use of the Foreign Service abroad as may be neces- 15 sary, and make payments therefor in advance ; and 16 (h) maintain, improve, and repair properties rented 17 or leased pursuant to authority contained in subsection .18 (g) of this section and furnish fuel, water, and utilities 19 for such properties. 20 SEC. 4. The Secretary of State is authorized to- 21 (a), make expenditures for unforeseen emergencies 22 arising in the diplomatic and consular service, and funds .23 expended for such purposes may be accounted for in 24 accordance with section 291 of the Revised Statutes 25 (31 U. S. C. 107) ; and Approved For Release 2000/08/25: CIA-RDP59-00224A000100480003-0 Approved For Release 2000/08/25: CIA-RDP59-00224A000100480003-0 4 1 (b) delegate to subordinate officials the authority 2 vested in hint by section 291 of the Revised Statutes per- 3 tainting to certification of expenditures. 4 SEC. 5. The Secretary of State is authorized to--- 5 (a) provide for participation by the United States 6 in international activities which arise from time to time 7 in the conduct of foreign affairs for which provision has 8 not been made by the terms of any treaty, convention, or 9 special Act of Congress; 10 (b) pay the expenses of participation in interna- 11 tional activities in which the United States participates 12 by authority of subsection (a) of this section, including, 13 but not limited to the following : 14 (1) Employment of aliens; 15 (2) Travel expenses without regard to the 16 Standardized Government Travel Regulations and. 17 to the rates of per diem allowances in lieu of sub- 18 sistence expenses under the Travel ]Expense Act of 19 1949, as amended (5 U. S. C. 835.-84:2) ; 20 (3) Travel expenses of persons serving with 21 out compensation in an advisory capacity while away 22 from their homes or regular places of business not 23 in excess of those authorized for regular officers and. 24 employees traveling in connection with said inter- 25 national activities; Approved For Release 2000/08/25: CIA-RDP59-00224A000100480003-0 Approved For Release 2000/08/25: CIA-RDP59-00224A000100480003-0 5 1 (4) Rental of quarters by contract or other- 2( wise; and 3 (5) Contributions for the share of the United 4 States in expenses of international organizations. 5 SEC. 6. The provisions of section 8 of the United Nations 6 Participation Act of 1945, as amended (22 U. S. C. 287- 7 287e) , and regulations thereunder, applicable to expenses 8 incurred pursuant to that Act, may be applicable to the obli- 9 gation and expenditure of funds in connection with United 10 States participation in the International Civil Aviation 11 Organization. 12 SEC. 7. The exchange allowances or proceeds derived 13 from the exchange or sale of passenger motor vehicles in 14 possession of the Foreign Service abroad, in accordance with 15 section 201 (c) of the Act of June 30, 1949 (40 U. S. C. 16 481 (c) ), shall be available without fiscal year limitation 17 for replacement of an equal number of such vehicles. 18 SEC. 8. The Secretary of State may, when authorized 19 in an appropriation or other law, transfer to any depart- 20 ment, agency, or independent establishment of the Govern- 21 went, with the consent of the head thereof, any funds 22 appropriated to the Department of State, for direct expendi- 23 ture by such department, agency, or independent estab- S. 2569 Approved For Release 2000/08/25: CIA-RDP59-00224A000100480003-0 Approved For Release 2000/08/25: CIA-RDP59-00224A000100480003-0 6 1 lishment, for the purposes for which the funds are ap- 2 propriated. 3 SEC. 9. The Secretary of State is authorized to enter 4 into contracts in foreign countries involving expenditures 5 from funds appropriated or otherwise made available to the 6 Department of State, without regard to the provisions of 7 section 3741 of the Revised Statutes (41 U. S. C. 22). 8 SEC. 10. The exchange of funds for payment of ex-- 9 peuses in carrying on activities abroad by the Secretary 10 of State., including the Foreign Service, shall not be subject 11 to the provisions of section 3651 of the Revised Statutes, 12 (3) 1. U. S. C. 543) . 13 SEC. 11. Appropriated funds made available to the De- 14 partment of State for expenses in connection with travel 15 of personnel outside the continental United States, including 16 travel of dependents and transportation of personal effects, 17 household goods, or automobiles of such personnel shall be 18 available for such expenses when any part of such travel 19 or transportation begins in one fiscal year pursuant to travel 20 orders issued in that year, notwithstanding the fact that such 21 travel or transportation may not be completed during that 22 same fiscal year. 23 SEC. 12. Notwithstanding the provisions of section 168, 24 of the Act of August 2, 1946 (5 U. S. C. 78 (a)) , the 25 Secretary of State may authorize any chief of diplomatic Approved For Release 2000/08/25: CIA-RDP59-00224A000100480003-0 Approved For Release 2000/08/25: CIA-RDP59-00224A000100480003-0 7 1 mission to approve the use of Government-owned vehicles 2 in any foreign country for transportation of United States 3 Government employees from their residence to the office and 4 return when public transportation facilities are unsafe or are 5 not available. 6 SEC. 13. The Secretary of State, with the approval of the 7 Bureau of the Budget, shall prescribe the maximum rates 8 of per diem in lieu of subsistence (or of similar allowances 9 therefor) payable while away from their own countries to 10 foreign participants in any exchange of persons program, or 11 in any program of furnishing technical information and 12 assistance, under the jurisdiction of any Government agency, 13 and said rates may be fixed without regard to any provision 14 of law in limitation thereof. 15 SEC. 14. Allowances granted under section 901 (1.) of 16 the Foreign Service Act of 1946 (22 U. S. C. 1131 (1) ) , 17 may include water, in addition to the utilities specified. 18 SEC. 15. Appropriations now or hereafter made avail- 19 able to the Department of State for allowances granted under 20 the authority in part A of title IX of the Foreign Service 21 Act of 1946, as amended (22 U. S. C. 1131), including an 22 allowance for water as authorized in section 14 of this Act, 23 shall be available for the payment of such allowances in 24 advance. 25 SEC. 16. The Secretary of State may, notwithstanding Approved For Release 2000/08/25: CIA-RDP59-00224A000100480003-0 Approved For Release 2000/08/25: CIA-RDP59-00224A000100480003-0 8 1 the provisions of any other law, prescribe regulations for the 2 payment on a commuted basis in lieu of any other method, 3 of expenses authorized by law for travel of personnel of the 4 Department and its Foreign Service, including travel of de- 5 pendents and for transportation, or for transportation and 6 storage, of furniture and household and personal effects, and 7 automobiles of such personnel. Appropriations now or here- 8 after made available to the Department of State for travel 9 and transportation expenses shall be available for payments 10 authorized under this section. 11 SEC. 17. Appropriations to. carry out the purposes of this 12 Act are hereby authorized. When so provided in an appro.- 13 priation law, an appropriation made to the Department of 14 State may remain available until expended.
