for officers and employees stationed outside the
U. S. for use in the U S., its Territories, or
possessions, and for other purposes*
le Subject bills have been reviewed in response to your re-
quest. These bills are identical to each other and substantially
the same as the "home leave" provisions of H.R. 3820 on which we
have commented previously.
2. It is noted that the proposed change in section 2062 (f)
would require that home leave taken in Territories or possessions
be used outside the area of employment. We believe this limitation,
not indicated in H.R. 3820, is a necessary feature.
3. It is recommended that the Agency continue its efforts to
obtain home leave benefits for its employees through. support of
these bills.

Mr. DAVIS of Georgia introduced the following bill; which was referred to the
Committee on Post Office and Civil Service
A BILL
To provide leave of absence for officers and employees stationed
outside the United States for use in the United States, its
Territories or possessions, and for other purposes.
1 Be it enacted by the Senate and house of Representa-
2 tines of the United States of America in Congress assembled,
3 That subsections (d) , (e) , and (f) of section 203 of the
4 Annual and Sick Leave Act of 1951, as amended (5 U. S. C.,
5 sec. 2062 (d) , (e) , and (f) , a re amended to read as
6 follows :
7 "(d) The provisions of subsections ((,,) and (f) are
8 applicable to the following categories of employees of the
9 Federal Government :
10 " (1) Persons directly recruited or transferred by

1 the federal Government from the United States or
2 from its Territories or possessions outside the area of
3 employ inc nt.
4 " (2) Persons employed locallbut (A) who were
5 originally recruited from the United States, or from its
6 Territories or possessions outside the area of employ-
7 meat, and have been in substantially continuous em-
8 ployment 1)y other federal agencies, United States firms.
9 interests, or organizations, international organizations ire
10 which the United States Government participates, or
11 foreign governments, and whose conditions of eniploy-
1.2 rent provide for their return transportation to the United
.1.3 States or its Territories or possessions, or (B) who
1.4 were at the time of employment temporarily absent
15 from the United States, or from its Territories or posses-
16 sions outside the area of employment, for the purpose
17 of travel or formal study and have maintained residence
18 in the United States, or in its Territories or possessions
19 outside the area of employment, during such temporary
20 absence.
21 " (3) Persons who are not normally residents of
22 the area concerned and who are discharged from service
23 in the Armed Forces of the United States to accept
24 employment with an agency of the federal Government.

1 is outside the United States returns on leave to the United
2 States, or to its Territories or possessions outside the area
3 of employment, the leave granted pursuant to this title shall
4 be exclusive of the time actually and necessarily occupied in
5 going to and from his post of duty and such time as may be
6 necessarily occupied in awaiting transportation. The pro-
7 visions of this subsection shall not apply with respect to more
8 than one period of leave in any twenty-four-month period.
" (f) Upon completion of twenty-four months of con-
10 tinuous service outside the several States and the District of
11 Columbia, officers .and employees may be granted leave of
12 absence, without regard to any other leave provided by this
13 title, for use in the United States, or in its Territories or
14 possessions outside the area of employment, at a rate not to
15 exceed one week for each four months of such service : Pro-
16 vided, That the granting of such leave shall be in accordance
17 with regulations of the President. Such leave may be
18 accumulated for future use without regard to the limitation
19 in subsection (c) but no such leave which is not used shall
20 be made the basis for any terminal leave or lump-sum
21 payment."
22 SEC. 2. The amendments made by this Act to the
23 Annual and Sick Leave Act of 1951 shall take effect on the
24 first day of the first pay period following the date of enact-
25 ment of this Act.
