1. This office is in receipt of the attached salary differentia
25X1A9a claim for claiming differential while on duty in
25X1 A6a during the perio ecem er 1951 through 22 June 1952.
2. In accordance with current proposed Agency procedure, payments
of post differential for periods of temporary duty shall be effective as
of the beginning of the pay period following 6 June 1953-
3. Department of State, Standardized Government Post Differential
Regulations (Foreign Areas) dated 1 July 1952 provides for payment of
salary differential to persons "on detail" as defined by paragraph 1.2 H.
This definition is identical with the definition presently contained in
section 350.1(g) of the Federal Personnel Manual.
4? It is the understanding of this office that there is an unpublished
Comptroller General Decision declaring this regulation illegal; however, the
only appropriate decision of which this office is Imowledgeable is B-106+69,
dated 19 December 1951 and contained in Volume 31, page 614. This decision
states in part that it becomes apparent that such differential is payable
only where the individual is stationed at the foreign post either as a result
of an assignment or transfer or is serving at such post "on detail" within
the meaning of that term as defined in the quoted regulations.
5. It is therefore requested that this office be advised as to the
legality of the attached claim and whether it may be certified for payment,
upon submission of evidence of "detail" as cited above.
