SUBJECT : Interpretation of
1. Because of the possibility of different interpretations of
with regard to overtime in training activities, we advise you herewith of
the procedure this Office is following.
2. This Office interprets paragraph 4. e. of subject regulation as
meaning that training time that falls within the normal day is not "hours of
work for purposes of overtime pay or compensatory leave," even though some
overtime on regular work -- possibly in part necessitated by the time taken
for training -- is claimed that day. For example:
a. Employee A works from 0830 to 1030 on his regular job, is
in an Agency sponsored training activity fromlO30 to 1230, works on
his regular job from 1230 to 1700, and also works on his regular job
from 1700 to 2000. Employee A may be credited with three hours over-
time.
b. Employee B works from 0830 to 1700 on his regular job and
is in an Agency sponsored training activity from 1700 to 1900. Employee
B will, effective 1 July 1953, receive no overtime credit for this da4Y.
(By special arrangement approved last fall, employees in seminar meet-
ings conducted by this Office after 1700 were credited with overtime;
this arrangement was discontinued at the end of fiscal 1953.)
