SUBJECT: Possible Conflict of Interest between Career Services
1. The question has been raised whether a staff employee of this
Agency can sign an application for and become a member of the Career
Staff if he has the following status as a retired Army officer:
Retired from the U.S. Army for combat-incurred disability:
Carried on the Regular Army retired list:
Disability, line of duty under section 1251, Revised Statutes.
It is my impression that under such retirement a person is subject to certain
Army regulations, rules, possible recall to limited duty, etc. It may be
that in the other Armed Services (Navy, Air, Marines) similar conditions
pertain. While it is my understanding that there is no problem about dual
compensation, the question may exist as to the allegiance of the individual
to the CIA Career Service vs, his allegiance to some other career service
to which he may have an implied obligation, especially in time of war.
There may also be conditions of retirement (i.e., retirement under different
statutes) other than those above which may have a bearing on the problem.
Lastly, it occurs to me that if any Army officer retired under conditions
stated above has become a member of the Foreign Service and is, in fact,
a Foreign Service Officer, a useful precedent had been established which
this Agency might well follow.
2. It would be appreciated if the answer to this question could be
available prior to 3 August 1954 at which time the question may be raised
at the Career Service Conference.
