1. Returned herewith are signed briefing statements from Mr.
Houston eased We appreciate your expeditious action.
2. As a pure technical acmmut concerning the briefing steate-
aeent, I would suggest that "Public Isar 513" be more specifically
identified as you have done on the copy of the Act itself. A more
citation of a public low by number Is not, for general legal purposes,
co dererd sufficient since it is possible that each session of Congress
oculA pease a last bearing a similar wadmw. Although in this case,
reference to the attached c -Of the law vtasld i? +es>!tify Public Lnaw 513,
It vould be preferable to specifically identify it In the briefing

3. liaaiaary discussions with the Depmrtsent of Justice have
resulted in their indicating that a prosecution under Public LAv 513,
now known as Section 798 of Title 18 of the U. S. Code, could not be
brought without reference to Rxecuttiive Order 10501 which establishes
the various categories of classified infomation. While this is a
tentative view of the Department of Justice, with which the undersigned
is not in ceaeplete agreement, I believe it is true in most ceases that
wherever cryptographic material would be involved, it would bear we
of the established security classifications established under the RKOM-
tive Order. Those categorieess steata from and relate to Sections 793 and
' of Title 18 of the U. S. Code. In view of the above, it is ted
that appropriate reference should be wade to Sections 793 and 794 in your
briefing statement.
