Subject: Applicability of the Mutual Defense Assistance Control Act
to Certain Transactions of the Export-Import Bank
Attached hereto for your information are copies of letters relating
to the subject matter,
The Export-Import Bank's letter sets forth the particulars regarding
two pending requests for credits by United States exporters and sought advice
as to whether, or not the assistance of the Bank in financing the proposed
sales would be barred because of the provisions of the Mutual Defense Assistance
Control .Act. My letter advised the Bank that the credits referred to do not
constitute "'assistancet' covered by the Battle Act. This advice is based on an
opinion provided by the Office of the Legal Adviser of the Department of State.,
a copy of which I am also attaching herewith for your information,
