Dear Cy:
I did not forget the request you made when we
talked together the other day and of which you remind
me in your letter of October 17. Frankly, I do not think
that at the moment there is anything further that can
usefully be said about the Powers contract. As I indicated
to you, the facts of the matter are that we are setting
aside adequate funds to meet any responsibilities to Powers
which we may have under the contract and when he is free
and able to deal with the matter, his rights will be deter-
mined by mutual agreement or if there are any questions,
by some fair form of arbitration. Meanwhile, out of these
funds, provision is being made for Mrs. Powers and to
protect any claims Uncle Sam may have for taxes.
At the moment it would not be either in the interest
of the government or Powers to prejudge the final disposition
of the matter.
It was good seeing you and I hope we can get
together soon again.
