Dear Mr. Huston:
In accordance with your request, I am sending you
a copy of:Malcolm Wilkey's letter to Chairman McCone of
the AEC dated March 10, 1959, and referred to in the
articles in the New York Times on Friday, January 5, 1962
and Sunday, January 7, 1962.
These opinions have never been publicized or released
by this Department. Apparently they were "leaked" to the
New York Times. In these circumstances, we will probably
release them publicly either to a congressional committee
or otherwise. However, in the meantime, any proposal for
the release of the opinion outside of the Executive branch
should be checked with this Office.
