States of America in Congress `assembled, That the Administrative Expenses Act of 1946 (60 Stat 4 806, as amended) is further amended by: (1) . In accordance with regulations prescribed by the President- " (a) Whenever any civilian officer or employee (in- cluding any new appointee in accordance with section 7 of this Act) is assigned to a permanent duty station at an Approved For Release 2005/04/13 : CIA-RDP66B00403R000500210001-1 Approved For Release 2005/04/13 : CIA-RDP66B00403R000500210001-1 3 1 isolated location in the continental United States to which 2 he cannot take or at which he is unable. to use his household 3 goods and personal effects because of the absence of residence 4 quarters at such location and where conditions of employ- 5 ment warrant it, nontemporary storage expenses (including 6 related transportation and other expenses) may be allowed 7 such officer or employee under regulations issued by the 8 head of the agency. In no instance shall the weight of the 9 property stored under this subsection, together with the 10 weight transported under section :L (a) of this Act exceed 11 the total maximum weight the officer or employee would be 12 entitled to have moved, and the period of nontemporary 13 storage shall not exceed three years. " (b) No reimbursement shall be made under authority of this section to employees traveling under orders issued more than sixty days prior to enactment of this section into law." For the past several months the problem of "out of pocket expenses" for Communications personnel being transferred within the United States has been discussed with members of your staff. As a result of my last memorandum Mr. John Warner indicated an interest in the case and is willing to discuss the Agency's position with appropriate officials if some specific cases might be made available to him. 2. Attached are some informal statements prepared by various communicators who have made PCS moves within the United States itemizing their expenses. As you are aware, the sponsor is the only one eligible for per diem during these transfers across country, and you can see from the- attachments considerable expenses were incurred by these various Communi- cations personnel. 3. I would appreciate your making this information available to the General Counsel Staff so that they might incorporate it with other material for discussion with their respective liaison contacts on the Hill. The Office of Communications policy has always been that every effort should be made to see that its employees receive everything to which they are legally entitled while working for the government; however, do not believe it is right that persons should pay money out of pocket for expenses incurred in the performance of an assignment with the government or this Agency.
