In connection with paragraph 3.g of proposed R 60-110, the question arises whether the wording proposed insures recognition of the waiver set forth under paragraph B of the attached "Basic Policy Governing the Release of Classified Defense Information to Foreign Governments." Specifically, the question relates to use of the phrase "including prosecution for unlawful disclosure" in paragraph B.2(b) of the "Basic Policy" paper. To date this phrase has not been cited in the conditions for the release of National Intelligence Survey units to 25X1 recipients. Current policy stipulates the conditions of release n terms only of paragraph B.2(a), (b) -- less the "prosecution for unlawful disclosure" phase --, and (c). 2. It is recommended that paragraph 3.g(l) be amended to read "(1) The criteria set forth in TAB C, 'Criteria and Conditions Governing the Release of Intelligence to Foreign Governments,' to IAC-D-115 1 dated 8 April 1958." Tab C is quoted by title only in USIB-D-51.3/3 dated 2 December 1958.
