8. Met with Colonel Scott Smith and returned
to him the papers forwarded from Senator Symington. After review of the
suggested changes in the draft paper, Colonel Smith commented that the
Agency's assistance in this instance was most helpful. See 26 January Journal.
9. et with Mr. Frank Slatinshek,
House Armed Services Committee, and reviewed with him in general
terms the concepts and positions considered by the Committee concerning
the "state of war" in Vietnam and received from him citations to back-
ground studies and a copy of the March 4, 1966 Department of State paper
"The Legality of U.S. Participation in the Defense of Vietnam". He was
of the personal opinion that declared war such as is required under the
uniform code of military justice for bringing civilians under the uniform
code does not exist in Vietnam.
10. et with Mr. Phil Kelleher, House Armed
Services Committee staff, and reviewed with him the questions he had
raised on behalf of the Chairman concerning the loss last year of the six
French Mystere aircraft and the constituent letter concerning the "Billy
Hargis Report" on Soviet space activities. Mr. Kelleher indicated that
he will be filing both queries. Also reviewed briefly the status of the
Agency's legislative package.
