Wednesday - 16 August 1967
1. (Internal Use Only - JSW) 'Senator Birch Bayh called me to
indicate that the Judiciary Committee yesterday had reported out S. 1035.
He stated that an amendment to exempt CIA and NSA had not received affirma-
tive action by a 6- 6 vote. He read me the language of the amendment which
did afford a partial exemption for the Agency and NSA. Unfortunately, he
had an urgent out of town call and we did not finish our discussion. It was
agreed we would go into this in more detail later.
Later in the day picked up in Senator Bayh's office the actual text
of the amendment. Miss Voorde also indicated that the Senator had stated
that he had heard that Senator Hruska planned to offer a floor amendment
to grant CIA and NSA a complete exemption.
2. (Internal Use Only - JSW) Talked with Richard Nelson, in the
offi, _ Senator Roman L. Hruska, to see if he had any information on
Hruska's plans on S. 1035. He stated that he had not been in touch with the
Senator today but would check into this and advise.
3. (Internal Use Only - JSW) Talked to Mr. Darden, Senate Armed
Services Committee staff, advising him of the Judiciary Committee action
yesterday on S. 1035. I specifically requested that as soon as possible, he
advise the Chairman of the Agency's concern about this bill. Mr. Darden
indicated that he doubted very much that Senator Russell would be willing to
sponsor a floor amendment to exempt the Agency.
4. (Internal Use Only - JSW) The Director, accompanied by Messrs.
I land Warner met with the CIA Subcommittee of House Armed
Services bee Memorandum for the Record.
5. (Unclassified - JSW) Talked with Mr. Kelleher, House Axmed__
Services Committee staff, about the Agency legislation. It was agreed that
we would prepare an analysis to assist him in working with the Philbin Sub-
committee. Mr. Kelleher also stated that he doubted that the Subcommittee
could conduct any hearings on this until after the Labor Day recess.
