SUBJECT: Cooper-Church Amendment

1. Scheduled for vote in the Senate this afternoon is the
"Cooper amendment" to the "Committee amendment #3 of the Foreign
Military Sales Act" (commonly referred to as the "Cooper-Church
amendment"). Although only the "Cooper amendment" is formally
scheduled for vote at 2:00 p. m. today, it is possible that once this is
disposed of, the "Cooper-Church amendment" itself will be voted on.
2. The "Cooper amendment" is apparently designed to take
the sting out of the attacks on the President's Cambodian policy implicit
in the earlier language. It does this by:
a. changing the words in the title from "prohibition"
to "limitation" of assistance to Cambodia;
b. stating that the limitation is "in concert with the
declared objectives of the President";
c. adopting the date of 1 July 1970 (previously
specified by the President as the deadline for withdrawal
of U. S. forces from Cambodia) as the effective date of the
amendment.
3. Aside from these changes in the preamble Section 7 remains
unchanged. It provides that, unless otherwise authorized, funds may not be
expended for the purpose of:
"(1) retaining United States forces in Cambodia;

"(2) paying the compensation or allowances of, or
otherwise supporting, directly or indirectly, any United States
personnel in Cambodia who furnish military instruction to
Cambodian forces or engage in any combat activity in support
of Cambodian forces;
"(3) entering into or carrying out any contract or
agreement to provide military instruction in Cambodia, or
to provide persons to engage in any combat activity in support
of Cambodian forces; or
19(4) conducting any combat activity in the air above
Cambodia in support of Cambodian forces. 99
4. Therefore, so far as the Agency is concerned, our earlier
comments regarding the implications of the Cooper-Church amendment
still apply.
