12 (a) This Act mail be cited as the "United States Foreign
13 Service Scholarship Program Act."
14 (b) The Higher Education Act of _1965 is amended (1)
15 by redesignating title XII and sections 1201, 1202, 1204, and
16 1205, and all references thereto, as title XIII and sections
17 1301, 1302, 1303, and 1304, respectively, and (2) by in-
18 serting after title XI a new title as follows:

"SEC. 1201. The Congress recognizes that the world and

1. all the peoples of the world in diplomatic, cultural, and coin-
2 mercial exchanges. The success of these exchanges and the
3 survival of the world may depend upon the ability, education,
4 training, and intelligence of the men and women charged
5 with responsibilities relating to the foreign affairs of the
6 United States. To assure that there is adequate opportunity
7 for the young men and women of the United States to enter
8 this vast field with the best possible training of their natural
9 abilities and to advance the professional education and train-

ing of the officers and employees of the Government cur-
rently engaged in the field of foreign affairs, there is hereby
established, as provided in the succeeding provisions of this
title, a United States Foreign Services Scholarship Program
(hereinafter referred to as the 'Program'). The members of
the Program shall be all students admitted to the Program
under section 120,1, and all officers and employees of the
Government admitted to the Program under section 1207,
who are enrolled in, a program of education, training, or
research, or a course of study, approved by the Board under
section 1204.
"DEFINITIONS
"SEC. 1202. As used in this title-
"(a) `Government' means the Government of the
United States;
"(b) `non-Federal institution of higher education'

1 means an institution of higher education which is not
2 owned or substantially controlled by the Government of
3 the United States;
4 "(c) `Board' means the Board of Trustees of the
5 Program;
6 "(d) `department or agency' means an executive
7 department, a military department, an independent estab-
8 lishment, or a Government corporation as specified in
9 chapter 1 of title 5, United States Code;
10 "(e) `training month' means any month during
11 which a member of the Program admitted under section
12 1205 is taking at least the minimum level of credit hours
13 in a full-time course of study prescribed by the Board,
14 or is taking field training as assigned by the Board; and
15 "(f) `dependent', when used in relation to a de-
16 pendent of a member of the Program admitted under
17 section 1205, means an individual who qualifies as a
18 dependent of such member under section 152 of the
19 Internal Revenue Code of 1954, as amended.

1 fications of, members of the Program for service with the
2 United States in positions or programs related to such field.
3 "(b) The Board shall consist of the Secretary of State,
4 four persons experienced in higher education or training and
5 education in foreign affairs, to be appointed by the Presi-
6 dent, two members of the United States Senate to be appointed
7 by the Vice President, and two members of the House of
8 Representatives to be appointed by the Speaker of the House
9 of Representatives. Not more than one of the trustees ap-
10 pointed from the Senate no? one of the trustees appointed
11 from the House of Representatives shall be of the same
12 political party.
13 "(c) (1) The term of each member of the Board up-
14 pointed from the Senate and the House of Representat ices
15 shall be two years.
16 "(2) The term of each member of the Board appointed
17 by the President shall be four years; except that of the first
18 four persons appointed by the President two shall be desig-
19 noted to serve for two years and two shall be desiynated to
20 serge for four years.
21 (3) Members of the Board shall be eligible for re-
22 appointment.
23 "(d) Vacancies created by death or resignation shall be
24 filled in the same manner in which the orujinal appointment
25 was made, except that the person appointed to fill the racancy

the Governor of the Virgin Islands;
"(II) three from Americans Samoa, nominated by
the Governor of American Samoa;
"(I) three from Guam, nominated by the Governor
of Guam; and
"(J) three from the Canal Zone, nominated by the
Governor of the Canal Zone.
"(2) No person may be nominated under clauses (B)

1 through (I), inclusive, of paragraph (1) unless such person
2 is domiciled in the State, or in the congressional district,
3 f rrom which such person is nominated, or in the District of
4 Columbia, the Commonwealth of Puerto Rico, the Virgin
5 Islands, American Samoa, or Guam if nominated from one
G of those places. To be eligible for nomination by the Gover-
7 nor of the Canal Zone, a person must be a resident of the
8 Canal Zone, or a member of the family of a resident of the
S) Canal Zone, or a member of the family of a civilian officer
10 or employee of the United States or the Panama Canal Com-
11 pany residing in the Republic of Panama.
12 "(3) After the initial three years of operation of the
13 Program, if the Board determines that the total number
11 of applicants who will be qualified and admitted as new
15 members in the Program prior to the beginning of (lily aca--
16 demic year under this section for the purpose of pursuing
17 courses of study during such academic year loading to under-
18 graduate or graduate degrees, respectively, will be below
19 the total number of applicants who may be so admitted to the
20 Program in accordance with section 1204(c), the Board
21 may nominate to to/1e a competitic'e examination held prior
22 to such academic gear, and select for admission to the Pro-
23 gram, in the order of merit established by f ,/ such e.rarninatiou,

1 such academic year and will not exceed the limitations set
2 forth in section 1204(c).
3 "(d) Applicants under this section shall be selected for
4 membership in the Program in the order of merit established
5 by the annual examinations held by the Board pursuant to
6 this section, but no person shall be eligible for admission as a
7 member of the Program unless he is a graduate of a public or
8
private secondary school described in subsection (b) in the
9 case of a student intending to pursue a coarse of study leading
to an undergraduate degree or a graduate of an institution of
higher education described in subsection (b) in the case of
a student intending to pursue a course of study leading to a
graduate degree.
"(e) Except as provided in this section, no competitive
or other similar examination shall be required for admission
of any person as a member of the Program under this section.
"COMPENSATION AND PAYMENT OF EXPENSES AND
SUBSISTENCE FOR STUDENT MEMBERS
"SEC. 1206. (a) Members of the Program who are ad-
rnitted under section 1205 and are maintaining satisfactory
progress in, and taking at least the minimum level of credit
hours in, full-time courses of study as prescribed by the
Board shall be compensated for tuition, texts, laboratory
ices and associated course niaterial,,~, and shall receive sub-
sistence payments as provided in this section. No coin pen-

1 satiun or payments shall be made except in accordance with
2 procedures established by the Board to assure their accuracy
3 and appropriateness.
4 "(b) The subsistence payments which shall be payable
5 under this section are as follows:
6 "(1) A single student member shall receive $200 sub-
sistence pay per training month.
"(2) A married student member having a dependent
spouse shall receive 5250 subsistence pay per training month,
and if they have a dependent child or children an additional
allowance of $30 for each dependent child shall be paid
per training month.
"(3) Where both a husband and wife member are stu-
dents under the program and are cohabiting, their joint
subsistence pay shall be $300 per training month, and if
they have a dependent child or children an additional allow-
ance of $30 for each dependent child shall be paid per train-
ing month.
"(4) Where both a husband and a wife member are
students under the Program and are legally separated they
each shall receive the same subsistence pay per training month
as would a single student, but if either spouse has a depend-
ent child or children an additional allowance of $30 per
training month shall be paid to the entitled spouse for each
25 dependent child.

"(5) Student members shall be granted an additional
2 allowance of $80 per training month for each dependent not
3 a spouse or a child of such student, member.

6 "SEC. 1207. (a) The head of each Government depart-
7 men, or ayencq is authorized (1) to select officers and em-
8 ployces of such department or agency who may volunteer to
9 he admitted to the Progra?n to pursue education, training or
10 research or a course of stud,?, within the Program, (2) to
pay all or any part of the pay (except overtime, holiday, or
night differential pay) of an?y such officer or employee so
selected for the period of such education, training or research,
or course of study, as a member of the Program, and (3) to
pay or reimburse such officer or employee for all or part of
the necessary expenses of such education, training, or re-
search, or course of study, without regard to section 529 of
title 31, United States Code, including the necessary costs of
(A) the travel expenses of such officer or employee and the
transportation expenses of his immediate family, (B) the
expenses of packing, crating, transporting, and temporarily
storing, draying, and unpacking his household goods and
personal effects to the extent authorized by section 5724 of
title 5, United States Code, (C) purchase or rental of books,
materials and supplies, and (D) all other services or facili-

1 ties directly related to the education, training, or research, or
course of study of such officer or employee with irt the I'ro-
dram. The head of each government department or agency
4 shall prescribe, with the approval of the Board, limitations
5 concerning the number of officers and employees of such
6 department or agency who may be selected for admission
7 to the Program at the same time and the period of time
which may be spent by such officers and employees in study,
training, or research, or a course of study within the Pro-
gram. The provisions of '~Ieetion 1206 shall not apply to any
Government officers or employees admitted to the Program
under this section.
"(b) Appropriations made available to any Govern-
ment department or agency or the payment of salaries and
expenses of officers and employees of such department or
agency shall be available for making payments under this
section to members of the Program selected from such depart-
ment or agency.
10 "(c) During any period for which any Government
cer or employee who is admitted to the Program under this
section is separated from his usual duties of employment with
any Government department or agency for the purpose of
education, training, or research or a course of study within
the Program, such officer or employee shall be considered to
have performed service, as an officer or employee of such de-

1 partment or agency at the rate of compensation received im-
2 mediately prior to commencing such education, training, or
3 research or course of study (including any increase in com-
4 pensation provided by law during the period of such activity)
5 for the purposes of (1) subchapter III (relating to civil serv-
e ice retirement) of chapter 83 of title 5, United States Code,
7 (2) chapter 87 (relating to Federal employees group life in-
surance) of title 5, United States Code, and (3) chapter 89
J (relating to Federal employees group health insurance) of
10 title 5, United States Code.
11 "(d) Each Government officer or employee who is ad-
12 mitted to the Program under this section shall, on completion
1 o of the period of education, training, or research or a course
14 of study within the Program, be entitled to continue service
15 in his former position or a position of at least like seniority
16 and status in the department or agency from which he was
17 selected for such education, training, or research or course
18 of study and shall be entitled to at least the rate of basic pay
to which he would have been entitled had he continued in
his usual service with such department or agency. On re-
sumption of his usual duties with such department or agency,
the department or agency shall restore such officer's or
employee's sick leave account, by credit or charge, to its
status at the time he commenced education, training, or re-
search or a course of study within the Program.

1 "AGREEMENT TO ENTER INTO OR CONTINUE GOVERNMENT
2 SERVICE AFTER COMPLETING THE SCHOLARSHIP
3 PROGRAM
4 "SEC. 1208. The Board shall obtain from each person
5 admitted to the Program, other than members of a family
6 receiving orientation or language training under section
7 1204(a), such agreement as the Board may deem necessary
8 to assure that such person will accept employment with the
9 United States, unless already so employed, and will remain
10 in the employ of the United States, wherever assigned by
11 the employing department or agency, for such period after
12 completion of their education, training, research, or course
13 of study within the Program as is prescribed by (1) the
14 Board in the case of students admitted to the Program
15 under section 1205, or (2) the head of the employing de-
16 partment or agency in the case of Government officers and
17 employees selected for admission to the Program from such
18 department or agency under section 1207.
19 "ASSIGNMENT OF STUDENT MEMBERS FOR FIELD TRAINING
20 AND GOVERNMENT SERVICE
21 "SEC. 1209. (a) During the course of study leading to
22 an undergraduate or graduate degree, each student admitted
23 to the Program under section 1205 may be assigned at the
24 discretion of the Board for field training with any program of
25 the Government relating to the Meld of foreign relations con-

1 tion, the Board shall consult with interested departments and
2 agencies of the Government to determine the pel sortnel require-
3 ments of their programs relating to the field of foreign affairs.
4 To the extent practicable, members of the Proyrwn shall be
5 assigned in accordance with their preferences for a particular
6 Government program.
7 "ROTATION FOR SERVICE IN THE UNITED STATES
8 "SEC. 1210. All members of the Program who have
9 satisfactory completed their education, training, or research,
10 or course of study within the Program and are employed by,
11 or remain in the employment of, the United States under
12 this title shall be assigned to Government ditties within the
13 United Slates for a minimum of one year during ever,r/ five
14 that they are employed in any Government program in the
15 field of foreign affairs; except that the provisions of this sub-
16 section may be waived when the United States is at war?
17 as declared by Congress.
18 "STAFF OF BOARD
19 "Sic. 1211. (a) The Board may appoint and fix the
20 compensation of a staff consisting of not more than five
21 tprofe.
