MEMORANDUM FOR THE RECORD
SUBJECT: Colonel White's Testimony on S. 4571
(CIA Retirement Act Amendments)
1. During Colonel White's testimony, Congressman Richard C.
White (D., Tax.), of the House Armed Services Committee, asked
if the annuity of a child survivor, terminated because of marriage,
could be resumed following a divorce. Colonel White's response
was to the effect that yes, he believed so, and whatever the answer,
the provision conformed fully with the Civil Service provision.
2. I believe this answer is supported by the proposed law as it
applies to a student. Section 204(b)(3), read in conjunction with pro-
posed Section Z21(e) specifically authorizes the commencement or
resumption of an annuity if an "unmarried child" again becomes a
student.
3. I Isaid he got an interpretation from Civil Service
to the effect that once divorced, an annuity may not be again resumed
and when I called him, he told me he had left a note to this effect for
Colonel White.
4. Recommendation: Call the Committee to find out if the tran-
script will be printed and make whatever corrections are appropriate
before the transcript is printed and correspondingly advise Congressman
White. This all being done in conjunction with Frank Slatinshek' a
advice.
