Approved For Release 2S MU : CIA-RDP74B00415R000100020074-4 OLC-72-0251 28 February 1972 MEMORANDUM FOR THE RECORD SUBJECT: Conversation with Mr. William Woodruff, Counsel, Senate Appropriations Committee 1. Today I met with Mr. Woodruff and he returned to me the answers which we had prepared to Senator Clifford Case's two questions on Soviet ICBMs. Woodruff said he discussed with Chairman Ellender the handling of items at such a sensitive security classification level. 2. The Chairman does not wish to place the Committee staff in the position of handling information above the secret level on behalf of any of the members of the Defense Subcommittee. (He does not want the Committee staff to give members material at extremely sensitive security classification levels for their personal possession and does not want to place the staff in a position of having to refuse to provide the member this information if he should request it.) Therefore, the Chairman has instructed Woodruff to have the Agency provide the answers to Senator Case's query to the Senator personally. Woodruff is so notifying Mr. William Mills, of Senator Case's staff, this afternoon. Woodruff said the Chairman also indicated that in the future the staff should not accept questions submitted "for the hearing record" since there is no such record. Members will be required to raise their questions directly at the hearing. 3. Mr. Maury has raised this issue with the Director who has instructed us to have Mr. Bruce Clarke reexamine his answer with the view to providing an answer which is responsive at a secret level. If that can be accomplished, we will reexamine the possibility of having this handled through the Committee staff.
