1. (Unclassified - GLC) Talked with Frank Slatinshek, Chief Counsel,
House Armed Services Committee, about the Congressional Record excerpt
of 10 November 1971 which he had given to Mr. Maury which contained a
lengthy statement by Representative H. Allen Smith (R., Calif.) on the rules
of the House of Representatives on the issue of germane legislation. Slatinshek
agreed with the position previously given to me by Mr. David Carper, of the
House Legislative Counsel's office, on this subject and also pointed out that
in the case of the Ervin bill Representative Celler could follow the precedent
established by Representative Smith. This would mean that Celler could
obtain a resolution from the Rules Committee which would waive points of
order on this bill and also allow an amendment specifically exempting CIA
and NSA.
2. (Unclassified - GLC) I called Herb Hoffman, House Judiciary
Committee staff, and mentioned that Frank Slatins had called our attention
to the procedure instituted by Representative H. Allen Smith on the Military
Procurement Authorization bill last year and I told Hoffman I would have
drop by his office today and leave him a copy of last year's floor
discussion. Hoffman said he would be interested in looking at it.
Hoffman said the House/Senate conferees had met today but reached
no agreement. They are scheduled to meet again next Monday. Hoffman is
quite certain that both Senator Ervin and Representative Celler will remain
adamant in their respective positions on the legislation and that ultimately
Geller will report the bill to the House noting technical disagreement on.the
Ervin bill portion of the legislation. He said at this point Celler could make
a motion that the House recede and accept the Senate version of the bill with
an amendment providing specific exemptions for CIA and NSA.
