Approved For Release 2006/0 P4RDP74B00415R000200020087-9 OLC 71-1053 5 October 1971 Assistant Legislative Counsel SUBJECT: Security Procedures 1.1 1 of Special Security Center, called and told me he had received a request from the Defense Intelligence Agency25X1 concerning delivery of a document from Mr. Packard, Deputy Secretary of Defense, to Senator Ell end r Chairman of the Senate Appropriations Committee. I Iwas advised. that NPIC 25X1 courier facilities will be used to take the document to Senator Ellender, wait for it while it is read, and return it to the Department. DIA requested advice concerning "the individual in Central Intelligence to be charged 'with' the document. " 2. After discussion I recommended tol that he tell DIA that control and custody of documents transmitted outside the Department is a matter within the Department's authority. I suggested he might also point out to them that in such a case there is no way of assuring that such a document upon delivery to a senior Member of Congress will be returned to the courier for delivery back to the Department.
