On reference from Mr. Briggs, OPPB, spoke with Jim Taylor, Budget Examiner, Office of Management and Budget, and answered his questions on Mr. Maury's letter to OMB on State's proposed report on S. Res. 192, Symington's Select Committee to Oversee CIA Activities. Mr. Taylor said that at first he hadn't realized that what was at stake here was a constitutional issue involving the separation of powers, but that he wished there was some way to come to a more accommodating view. I told him that I thought the record was quite clear that the Director had gone to great lengths to make himself available to the various committees of Congress to brief them on matters within their jurisdictional areas of responsibility. 17. ( David Dittman, in the office of Senator Ted Stevens (R. , Alaska), called on behalf of a constituent who is complaining that the Agency had not been responsive to his request for information on educational requirements as they relate to Agency employment possibilities. I told him we would be glad to check on the application of if he would send us the correspondence. John Lehman, on the White House staff, called to ask if the Agency was appearing this week before the Nedzi Subcommittee regarding the Hebert/Arends bill (H. R. 9853) on security of classified information. I said we were not, in view of our policy against appearing in open session. Lehman was glad to hear this. He asked my views about trying to delay hearings on this subject until next month so that the Administration's position could be clarified and further work completed in the NSSM 13 exercise. I said one argument against delay was the possibility that the Moorhead Subcommittee would pick up the ball and run with it, and I thought we were better off dealing with Nedzi. Lehman said this was a consideration which hadn't occurred to them, and maybe they had better take another look. He asked how we were getting along with Nedzi and I said there were no major problems at this stage. This seemed to surprise him. Lehman said he had a friend leaving the Navy who was interested in a job with Air America. I suggested his friend contact Air America's office directly, but told Lehman to let us know when he did and give us any recommendations he might want to offer so we could be sure they got full attention. Brown's, Deputy Assistant Secretary of State for East Asian Affairs, request for guidance in responding before the Senate Foreign Relations Committee if asked about the number of CIA personnel on the country team, forwarded to DC /FE, a copy of the Department of State's 16 EINovember 1971 letter. In accordance with the letter which forwarded to the Foreign Relations Committee the numbers of personnel in place by country and by agency, it was recommended that Ambassador Brown, if questioned about CIA personnel, respond to the effect that he will arrange for the Department to provide this information to the Chairman. 11. Talked to Mr. Bruce Clarke, OSR, who told me he had a good meeting with Mr. Fred Wikner, assistant to Dr. John S. Foster, Director of Defense Research & Engineering, Department of Defense, and relayed to him the information provided in the meeting with Mr. Frank Slatinshek, Assistant Chief Counsel, House Armed Services Committee, concerning differences in the information provided by the Director and Dr. Foster on Soviet R&D. Mrs. Edwards, in the office of Repre- sentative Augustus F. Hawkins (D. , Calif. ), called in behalf of a con- stituent who provides helicopter services and had requested that she query various Federal agencies. I informed Mrs. Edwards that the Agency had no need for helicopter services and would not be interested. 11. I Met with Mr. Frank Krebs, Legislative 25X1A Assistant to Senator Howard Cannon (D., Nev. ), on the inquiry originally made to the Air Force by Senator Cannon for on behalf of Mr. Krebs appreciated the background of the case and said he could handle it nicely without attribution to the Agency, using our suggested reply. In keeping with an earlier agreement, I informed Lieutenant Colonel Delmar, Air Force Legislative Liaison, that we had closed out the inquiry with Cannon's office. Mr. Krebs said that Senator Cannon had expressed interest in revisiting a sensitive Agency location, but that he is too busy to consider such a trip now. I offered our assistance in this connection. 12. Mr. Gene Kopp, Deputy General Counsel, USIA, called to express concern over the possibility that the restrictions now found in the Church bill, imposing restrictions on infor- mation activities outside the United States (S. 1397), might be incorporated into the authorization legislation for USIA during early March hearings before the Senate Foreign Relations Committee. I thanked him for calling our attention to this possibility and said we would reassess the bill's impact on our activities, looking towards such modifications in the language as may b needed, and we agreed to keep in touch on further developments. Mr. Ko3,XlA also raised the possibility of our help with "your many friends on the Hill" on legislation in which we had a mutual interest. In response to an earlier call from the Connecticut office of Senator Lowell Weicker (R., Conn. ), responded to an inquiry from Mr. Harper on behalf of an Agency employee who is retiring. Y. ), requesting a copy of the "People's Republic of China" atlas. I told Mrs. Akins we would be happy to provide a copy for the Congressman's use and will drop one off in the next day or two. 14. Called Sam Goldberg, on the staff of Senator Charles McC. Mathias (R. , Md. ), about his call requesting a briefing for Senator Mathias and Senator Philip A. Hart (D. , Mich.) on certain aspects of the nuclear test ban issue. I told Goldberg we had taken this up with the Director who felt that since this was essentially a policy matter any briefings which the Senators received on this subject should be given by representatives of the Atomic Energy Commission. I said the AEC was in possession of all the information we had on the subject of Soviet programs as well as on the subject of detection capabilities. Goldberg said he understood and was sure Senator Mathias would understand also and appreciated my timely response. George Murphy, Joint Committee on Atomic Energy staff, called to discuss the Director's appearance yesterday. He asked if I felt that his comments on the case of some missing "yellow cake" uranium were clear. I said I thought he summarized the case accurately. He agreed with my recollection that the only item on which we were committed to supply supplementary material for the record concerned Senator Aiken's question about Israel supplying fighter aircraft and small arms to Guatemala and other small countries. However, he said he would check the transcript to see if there were other items that required .followup action. He said the entire presentation had been completely successful, but all the members were especially impressed with the Director's extemporaneous. discussion of the political situation in China, which Senator Pastore had commented on most enthusiastically. 14. Schweiker (R., Pa. ), a People's Republic of China Atlas for the Senator's use. 16. I Sam Goldberg, on the staff of Senator Charles McC. Mathias (R., Md.), called. He said Senator Philip Hart (D., Mich.) has interested Senator Mathias in his proposal to extend the nuclear test ban treaty to include underground testing. Goldberg said Senator Mathias has gotten quite interested in this and has received briefings from DOD and AEC on the subject but he and Senator Hart would like to hear from us. They would like us to tell them what the Soviets are doing in the field of underground nuclear testing and to give them our judgment as to whether a U. S. move to ban this type of testing (either unilaterally or otherwise) would place the U. S. in a disadvantageous position vis-a-vis the Soviets. They would also like us to brief them on the state of the art for detecting such tests. Goldberg said the only time the two Senators would be available for a briefing in the immediate future is tomorrow morning at 9:30. They realize that responding on such short notice is an unreasonable request and, therefore, would be willing to defer the briefing if we cannot make it tomorrow. I told Goldbert I doubted we could do anything by tomorrow morning since this had to be taken up by the Director, but I would raise the question and be back in.touch with him as soon as I had an answer. I told Murphy that General Ed Giller, of AEC. had been in touch with Senator Baker and they agreed to get together in the near future when both have returned from trips which they are taking. 25X1A 8. called to advise that Henry 25X1A Cox, the P e i en s a visor on the drug problem, had asked if he would be willing to brief a Republican caucus on the subject drug situation. sidestepped this with the suggestion that Cox get someone from the Bureau of Narcotics and Dangerous Drugs for this purpose with the understanding that would provide the BNDD 25X1A representative with.some suggestions on how to cover the subject. Cox accepted this suggestion and another which lmade to the effect that 25X1A this be a bipartisan briefing. I Mr, Floyd Sweet, of NASA.. called for advice on how they should handle a query from Representative Joseph McDade (R., Pa.) concerning an article "Secret Sensories in Space" by Phillip Class in Aviation Week magazine. Sweet was concerned as to how NASA should handle this sensitive subject with McDade. Sweet specifically asked whether we briefed Chairman Mahon at sensitive classification levels. I told him we briefed Mr. Mahon on anything he wanted to know about our business regardless of classification level, but suggested that NASA might want to take the matter up with Mr. Ralph Preston, of the House Appropriations Committee staff, and obtain his advice as to how to handle it. OTR, suggested that we try to firm up t e date of 7 March 197 at 2 p. m. for a briefing of the Advanced Intelligence Seminar by either Russ Blandford or Frank Slatinshek, of the House Armed Services Committee staff. 25X1A 3. Delivered to Mr. Frank Slatinshek, Assistant Chief Counsel, House Armed Services Committee, the original of the transcript of the Director's briefing of 8 February. Mr. Slatinshek indicated that it would be best if he holds the transcript for some three or four days so that it can be immediately available for Committee use. He will then return it to the Agency for safekeeping. Woodruff recommended that the Director cover a prepared text on the Soviet Union, Communist. China, and Southeast Asia, leaving other areas for the question period. He said the Subcommittee was skeptical about recent testimony of Admiral Zumwalt regarding the rapid expansion of the Soviet navy, and Woodruff recommended the Director devote "four or five minutes"to this subject. Woodruff said he would like to get from I "within the next 25X1 week or ten days" a "money and people" paper for FY 1973 on CIA, DIA, NSA and NRO, similar to the paper provided last year. Woodruff said Chairman Ellender wanted a special briefing on the intelligence community from Mr. Helms and Assistant Secretary of Defense (ISA) Albert Hall in the near future--possibly appearing jointly, although Ellender has not made up his mind on this aspect. Woodruff said that, although he planned to hear from both the Director and Hall, Ellender would probably try to hold the Director responsible for the entire community. Woodruff expressed concern over the reference to tactical intelligence in the Presidential directive, and I assured him that this was something which we felt strongly had no place in the community picture. Woodruff agreed, noting that excluding the costs of tactical intelligence would help him to cut the figure on community intelligence costs. Director's appearance next week before the Defense Appropriations Subcommittee. In response to his earlier request, I briefed Senator Young on the status of Indian nuclear development. 10. Lunched with Ed Braswell, Chief Counsel, Senate Armed Services Committee, and discussed some problems involving community matters. 11, In response to J. Sourwine's, Chief Counsel, Senate Inter a Security u committee, request and in his absence, I spoke with Sam Scott, of the Subcommittee staff, and advised him that according to our information all the Soviet diplomats who were PNGd by Mexico returned to the Soviet Union and are still there. Called George Murphy, Joint Committee on Atomic nergy staff, in connection with a message which he left yesterday to the effect that Senator Howard Baker (R. , Tenn.) might be calling the Director on a sensitive matter. I told Murphy that Senator Baker had, in fact, called the Director on Wednesday and that Mr. Maury subsequently talked with the Senator advising him that we were in no position to provide a useful answer to his question and that alternative arrangements were being made for General Ed Giller, of AEC, to discuss the matter with him. I added that General Giller subsequently did talk to the Senator who was completely satisfied. if we could ma a arrangements to have r. Peter Lakeland, of Senator yyy Javits' staff, or some other suitable congressional staffer, meet with an Advanced Intelligence Seminar class on the Hill some time in March (probably either the afternoon of the 7th or the morning of the 14th). Met with Mr. Frank Slatinshek, Assistant Chief Counsel, House Armed Services Committee, who told me that Chairman Hebert would appreciate a briefing by the Director for the full Committee on either Monday, the 7th, Tuesday, the 8th, or Wednesday, the 9th of February. The briefing would be the annual worldwide roundup. The briefing would be a morning session for 10:00 a. m. The Director has been advised. 11. Met with Mr. Ralph Preston, House Appropriations Committee staff, who told me he thought that the letter from Chairman Mahon to Chairman Dulski ., House Post Office and Civil Service Committee, had gone forward. I thanked Mr. Preston and told him I would check the Post Office and Civil Service Committee to see if it had been received. He told me that he had received the information he had requested on the Radios from Mr. James Frey, of OMB, and stated that this is all that he needs from us at the present time. Mr. Preston told me he would like to schedule for himself and Mr. Woodruff, Senate Appropriations Committee staff, to visit Headquarters as soon as the budget book is ready. Once that session is behind us we can then start looking to a date for the Agency budget presentation before the Special Subcommittee. Mr. Preston told me also that he has received a question from one of the sensitive DOD components concerning possible date for that organization's appearance before the Special Subcommittee and asked that I relay this item to John Clarke. I reviewed with Mr. Preston the administrative arrangements for tomorrow's briefing. In part Mr. Preston told me that an invitation has not been extended to the Military Construction Subcommittee for attendance at tomorrow's briefing and that the Chairman has not yet appointed a replacement for Representative Andrews. 12. Spoke wit General Counsel, 25X1 National Security Agency, and he said that they had not received requests for views from either Office of Management and Budget or Chairman Hebert, House Armed Services Committee,on H. Received a call from Mr. Ralph Preston, House Appropriations Committee staff, who said that the Committee would be very interested in Soviet shipbuilding and in particular the vessel under construc- tion that the Navy thinks is a carrier. I told Mr. Preston that they would be included. OCI, has been advised. 2. Talked to Mr. Richard Barton, Employee Benefits Subcommittee, who told me that H. R. 11150, for the protection of the rights of Federal employees, has been included on the agenda for the full Committee meeting on Thursday. There are several controversial items ahead of it, however, Mr. Barton does not feel that this bill will be considered at this week's meeting. The next scheduled meeting of the full Committee will be on the 17th. 3. Representative Donald Riegle (R. , Mich. ) and his Administrative Assistant, Mr. Carl Blake, visited Headquarters and met with Mr. George Carver, SAVA, who updated information previously provided the Congressman on Indochina. There are no followups from the briefing. Representative Riegle noted on leaving that overall Indochina is like a bone in the throat particularly in the appropriations process and he anticipates serious discussion before final approval of the various measures pending before the Passman Foreign Operations Subcommittee of the House Appropriations Committee of which he is a member. 4. Talked to Ed Braswell, Chief Counsel, Senate Armed Services Committee, about the followup on Senator Stennis' request for a paper comparing Soviet and U. S. navy capabilities. I reminded Braswell that he would have to go to the Pentagon for the U. S. side, but he said "this would be a waste of time" and he didn't know how he would handle it, but he appreciated that we couldn't help him on this. He said on the Soviet side he would like a paper showing the present strength of the Soviet navy and also a projection for the next three years, and would appreciate having it in about a week.
