4. (Unclassified - LLM) Craig Pettybone, Civil Service Commission, called
to find out the status of the Agency' s proposed funding legislation for retirement
forwarded to them during the last Congress. I reviewed the situation briefly
with M. Pettybone and told him that as far as we understand it, it's up to Civil
Service, Treasury, and OMB to resolve the problem relating to the definition of
"unfunded liability", and that when this is done we will be informed by OMB and
will draft and submit conforming legislation.

This is in response to your request for advice on a
draft bill "To amend the Central Intelligence Agency
Retirement Act of 1964 for certain employees, as
amended, and for other purposes."
This will confirm the informal advice given Mr. John
Maury of your staff by Victor zafra of this office on
October 12, 1970, that there is no objection, from
the standpoint of the Administration's program, to
the submission, as separate legislation, of Title II
of the draft bill.

Also, as we advised your staff, we plan to review
further with the Central Intelligence Agency and othe
1 interested agencies the questions of fully covering
normal cost and the definition of unfunded liability
with the objective of submitting legislation to the
92nd Congress.

attached. Further, it is
understood that the CSC
Actuary Board is currently
considering the related key
issue--the definition of
"unfunded liability. "
It seems that we have two
choices--either let the matter
come to a head of its own
accord as it seems to be doing,
or stir the pot a little. Any
recommendation?
Also attached for your infor-
mation is a letter which you
probably recall from last year
which technically leaves the
initiative with OMB.
