Ue contacted you by phone about your accident of on May 4, 1972. 25X1 A
On the afternoon of 4, 1972, 1 personally discussed the coverage aspects
of the accident with you at your hone. At that time I delivered a copy of
our "Request for Claim Service and Won46}laiver of Rights". You verbally
agreed to the matters in this documat but did not want to sign the agreement.
The essence of the situation is that if you were in the course of your
employment for the Federal Government, the Federal Tort Claims Act will apply.
This federal law, in general, eliminates personal legal liability on your
part and substitutes the Federal Government. AIrr1c exclusion in your
policy with our company a'f states that the policy does not apply if the
Federal Tort Clair Act applies
As per our agre nt, we Will continue to investigate the liability aspects
of the accident under the non-waiver agreement until such time as it is
determined ether or not on the facts and the law the Federal Government
will handle the liability claims arising out of your accident.
I referred you to our company attorney for this area in the event you wanted
further information on this aspect. This attorney, Edward Layne, 255 North
Washington Street, Rockville, ifaryland-telephony. number 762-6656, will be glad
to give you any further advise on the civil aspects of this matter which you
desire.
In any event we will handle the collision coverage on your 1968 Triumph just
as soon as practical.

which is made a part of this letter by reference.
