MEMORANDUM FOR: Assistant Deputy Director for Support
SUBJECT: Building Maintenance
1. At our meeting on 6 January 1972 on the above subject,
it was agreed that this office would look into the police powers aspects
of the GSA guard force and a guard force run by the Agency. Attached
is a memorandum prepared by dated 31 January 1972
dealing with police powers and Agency control of the guard force. Mr.
points out that in order to have appropriate police powers, an
Wgency-controlled guard force would have to secure legislation for
such purpose. It would appear doubtful that the Director would approve
seeking such legislation and certainly there are serious political aspects
to consider.

2. The second item that OGC was to accomplish was an appraisal
of proposed legislation. The Senate has passed S. 1736. Insofar as our
interest is concerned, it would require all Government agencies to pay
into a Federal building fund rental equivalents as well as costs of
maintenance, repair and other services including reimbursement for
guard services. There is a similar bill in the House, H. R. 10488, and
the House committee has ordered this favorably reported although there
is no written report yet. The Office of Legislative Counsel has checked
into this matter and advises that while the House bill is not the highest
priority they do expect favorable action during this session. It is,
therefore, to be expected that there will be a final bill. The provisions
of concern to the Agency are substantially similar in both bills.
3. With the above prognosis for a law in this area, it would
seem we have a' sound basis for initiating discussions with GSA in
attempting to arrive at cost figures. We can well argue that we need
to plan ahead for budgeting purposes and, consequently, want their
assistance in estimating costs.
