MEMORANDUM FOR: AD/DCI/IC
SUBJECT: Unclassified Omnibus NSCID
1. The outstanding question raised by Senator McClellan
with respect to NSCIDs apparently can be satisfied by an unclassified
statement of functions and responsibilities which has been prepared.
2. In the time allotted, we have been unable to do a complete
and detailed review of the substantive information contained in your
draft but if this goes forward undoubtedly the specific provisions can
be looked at again. We do note paragraph 7i. on page 11 which we
would recommend be eliminated.
3. We believe there are a number of reasons for not going
forward with this. The practical purpose of gaining coordination from
the various departments and. review in the White House would, undoubtedly,
be time consuming. Additionally, however, we are concerned about the
timing. There are numerous bills introduced on the Hill to modify the
Agency charter. Some of these are extreme and could cause serious
difficulties for the Administration and the Agency. However-, Senator
Stennis is actively pursuing amending legislation in a responsible fashion
and the Nedzi Subcommittee clearly is going to do likewise. This raises
the question that if an unclassified NSCID appears there will, undoubtedlyy
be raised the question of why the "Agency charter" should not be placJ&TIIVTL
in legislation. Clearly such a result would be undesirable.

As I mentioned in the hall today, the Director
has approved the authority to settle claims of em-
ployees to compensate for loss or damage to per-
sonal property incident to their service. See a
copy of our paper approved by the Director on
9 January 1974, attached. I believe this permits
the DD/M&S to approve thellaim in the
amount of $10,000 and that his action need not await
the revision of the Agency re ulatio ,
