Action Requested: It is requested that the attached memorandum be forwarded to the NSC Under Secretaries Committee over your signature. 2. Background: The attached memorandum asks that the President make policy decisions in two areas affecting the current Micronesian status negotiations: (1) Whether independence ought to be among the options offered the Micronesian negotiators during the status talks and (2) how long the moratorium period on unilateral termination of any compact of free association ought to be. We have no problems with the material offered in support of these recommendations. 3. Staff Position: The Office of General Counsel and the Deputy Director for Intelligence have reviewed the attached material and concur in the action proposed in paragraph four below. 4. Recommendation: It is recommended that you sign the attached memoran um so that it can be forwarded to the NSC Under Secretaries Committee. S. national objectives, policies, and programs in Guam in order to identify prospective courses of action by which U. S. interest ma be most effectively fostered. It is my understanding that C/EA/OCI and Mr. STATINTL EA/DDO, were initially designated as the Agency participants in this undertaking. 2. On 2 October called requesting the opinion STATINTL of this Office regarding the legality of Agency participation in sucbSTATINTL a study. I advised that while we could certainly advise the group on intelligence matters (Section 102d of the National ct of 1947) we did not participate in policy formulation ParTATINTL graph 22a). Subsequent to that discussion it is my understanding that C/EA/DDO, the DDI, and the C/EA/OCI met and decided that the Agency should not participate in the study and that was to so advise the group at their meeting on 3 October 1973. 3.
