MEMORANDUM
4 January 1973
SUBJECT: Pan American Case
1. In connection with the Pan Ameri can suit against
Aetna regarding a 747 destroyed by the PFLP in Cairo, the
American insurance underwriters filed a very broad request
for the Government to produce all sorts of information about
the episode itself, the PFLP and other Arab groups and
individuals, and connection with the Agency.
Over the months is has teen narrowed o some extent by our
and our declassifica-
n o certain reports on individuals which had no particular
source or method problem. A group of reports which we had
submitted to FAA came up for consideration. These involved
TDCSs and cables, all of which had very specific source and
method problems. Accordingly, we filed a Claim of Privilege
based on State Secrets, which so far has been accepted by the
Federal District Court in New York. We have also filed an
Affidavit that certain other reports which were requested were
not among CIA's own documents.
2. Our latest information is that next Monday, 8 January,
the Judge will ask whether the documents we have either submitted
or have claimed as privileged are all the documents we have
pertaining to this episode. Research is being done on this question, STATINTL
and we will work out an appropriate response with the U. S.
Attorney for Monday morning.
