Approved For RelebsQi ~i j f fF I4 DP75B00380R000100070069-3 Journal - Office of Legislative Counsel Page 2 Tuesday -- 15 May 1973 4. 1_ I Talked to Ed Braswell, Chief Counsel, Senate Armed Services Committee, regarding the release of the Walters' affidavit and Braswell said that one solution might be for the Committee, which had already run off a number of copies for possible release, might be authorized by Walters to release the affidavit. After discussing the above suggestion with Walters, I called Braswell back to say that Walters had just talked to Earl Silbert, Principal Assistant U. S. Attorney, who recommended against the release of the statement, particularly by CIA, since he felt to do so might impede the prosecution of John Dean. I said in view of this we were caught between Senator Symington's desire to release the a.f.fidavit and Silbert's recommendation against the release and in the circumstances I would just have to wait until we could take the matter up with the Director, who was downtown at a meeting and not expected back until late. In any event Braswell said it was too late to do anything about it today. 5. Frank Slatinshek, Chief Counsel, House Armed Services Committee, called to say Chairman Nedzi, Intelligence Sub- committee, would like the Director to appear at 11:00 a. m. tomorrow if convenient, along with Messrs. Colby and Houston. I said I was not sure of the Director's commitments but suggested if he was tied up, the simplest solution would be for him to provide written answers for the record in response to any questions. Slatinshek said this would probably not be satisfactory, since the Chairman had several questions that he would like to raise with the Director personally "to fill in some of the holes" in previous testimony. I told Slatinshek of our problems with the release of Walters' affidavit, and Slatinshek indicated that if the General put it into the record in his testimony tomorrow, Nedzi might agree to release it if we so desire. After consulting the Director, I called Slatinshek back to say the Director would not be available at 11:00 tomorrow. Slatinshek asked if he could come up at the same time Ambassador Helms is appearing on Thursday, 17 May. After checking with the Director, I called back to tell Slatinshek the Director could appear at that time and that Larry Houston and I would accompany him. At Slatinshek's suggestion, I called Bill Hogan, of the Committee staff, to confirm these arrangements. Hogan said that unless we are, notified to the contrary, the hearing on'.the 17th will be at 2:30 p. m. in room 2337 Rayburn.
