Edward Hebert, Chairman Committee on Armed Services House of Representatives Washington, D. C. 20515 This is in response to your request of 20 February 1973 for our views and recommendations on H. R. 4294, "War Prisoners Retirement Benefits Act of 1973. " H. R. 4Z94 applies to military members of the Armed Forces and participants or members of the Civil Service, Foreign Service, and CIA retirement systems. The bill provides additional service credit for retirement equal to the period spent as a prisoner of war or in a missing person status. We are pleased that H. R. 4294 amends the Central Intelligence Agency Retirement Act of 1964 for Certain Employees as legislation of this type, if enacted, should be broadly applied to Federal staff retire- ment systems. Snce the service credit provision in the CIA Retire- ment Act is based upon the precedent of the Civil Service Retirement Act, we defer to the views of the Civil Service Commission on the policy implications of H. R. 4294.3 It is noted-. f iatt secf~ion 3 of the bill applies to both a member or former member'othe Armed Forces whereas sections 4, 5, and 6, covering the Foreign Service, Civil Service, and CIA retirement systems, limit the double retirement credit to those in an employee status as of the date of enactment. The Office of Management and Budget has advised that there is no objection to the submission of this report from the standpoint of the Administration's program. Sincerely, James R.
