LC) Called the following Agency contact points regarding a us ie u committee on Surveillance and advised them of my meeting with Tom Korologos, of the White House staff, and also that the Director may bring this matter up at the USIB meeting tomorrow: a. Bill Donovan, Investigative Service, Department of the Navy. Donovan said they had seen nothing on this yet but he would advise their USIB representative. b. Marvin Gentile, Deputy Assistant Secretary of State for Security. Gentile said they have an incomplete draft they are supposed to meet on soon and he will keep us advised. c. Merrill T. Kelly, Deputy Director for Operations, Army ACSI. Kelly said they have been kept quite busy with the Ervin Committee questions and an ACLU suit. He said he would send over copies of the answers to these questions for our information. d. General Counsel of NSA. said they 25X1 never received questions from Norvill Jones, of the Subcommittee staff. Jones has just called several times but 1doesn't answer the 25X1A calls. e. Colonel Ned D. McDonald, Air Force. He said he was unaware of the whole thing. He will check into it and be back in touch with me. Appropriations subcommittee. PLC) Met with Tom Hart, Senate Judiciary Committee staff, who handles Committee matters for Senator Robert C. Byrd (D., W. Va.). We.discussed S. 2543. which amends the Freedom of Informa- tion Act and overrules the case. Hart strongly supported our position on the bill. He made it clear, however, that Senator Byrd, though a strong advocate of law and order and supporter of the Agency, is very unpredictable on the positions he will take. He felt sure that if the Agency makes a good case, Senator Byrd will support us. He suggested that we prepare a detailed memorandum justifying our position which Hart will use in discussing the bill with Byrd. Hart feels certain that the Judiciary Committee will report out a bill, as the feelings in the Senate on this matter are running very high. He hoped that he could get Senator Byrd to agree to our amendments. He suggested that we continue our efforts with the other staff personnel, as he feels the Agency has a good case. He further suggested that the Director submit his written comments on the bill to Chairman James O. Eastland (D., Miss.) and to Senator John L. McClellan (D., Ark.) as Chairman of our
