DIARY NOTE
DD/S 25 February 1972
Meeting with the Executive Director-Comptroller: On this date
I discussed a number of matters with the Executive Director. These
included:
a. A number of space related matters (garage, DCI
Conference Room, AO/DCI) which are covered in a memorandum
to the Director of Logistics (DD/S 72-0765).
b. Our all employee bulletin - Headquarters _
proposal which is enroute to him via the DD/P. I
explained generally the contents and our hope that the DD/P
will agree. I offered to leave a copy but he suggested waiting
until the formal copy is received.
*c. CIA Classification Review - I explained the present
status of the notice produced by O/S with the assistance of
members of the intra-Agency committee noting in particular
that it is based upon EO 10501 which may momentarily be
superseded. Mr. Colby agreed that we should hold off on this
notice pending some resolution of the Government-wide matter.
I suggested that we might consider putting out a paper limited to
the matter of overclassifi cation which was theoretically a safe
matter under any Directorate.
Mr. Colby asked whether there might be a basis for a
separate classification based on the DCI's legal authority/
responsibility for protection of intelligence sources and methods.
If such were possible we could avoid the problem which we now
face of using security classification for papers which have no real
National security significance but need protection from exposure
under the Freedom of Information Act. I told Mr. Colby that I

would discuss this idea with Mr. Houston. (I subsequently met
with Mr. Houston and he will research this problem beginning
with the Freedom of Information Act itself. He pointed out that
one of the problems with the CIA Act is that it provides no
sanctions and that this type failing was noted by the Supreme
Court in its Government-wide opinions.)
