Following the briefing, Senator Clark expressed his deep gratitude for the almost constant briefing service we had provided him; observed his obviously would be the last session on Vietnam and suggested that we might, however, be meeting with him on other issues in, the future. 25X1A 16. We stressed the absolute essentiality that no attribution be made to the Agency on any information he used and the particular sensitivity of the information in the NID which he cannot: use.. 17.. Gordon Frey, in the office of Senator Thomas J. McIntyre (D. , N. H. ), called to advise us that he had received a complaint from a constituent, , that the Agency was not promptly handling his request under the Freedorn of Information Act. I explained to Frey that a large volume of these requests had been received in a very short period of time and they could not be handled promptly, however, all efforts were being made to handles them as quickly as possible. Frey said he understood this completely and made it clear that he would not press us in this matter. I told him, however, f would check on the status of this request and let him know. 15.1 1 George Gilbert, OMB, called and requested fifteen additional copies of the Agency's revised package proposing legislation to protect intelligence sources and methods. He asked for the copies as quickly as possible and stated that they intend to expedite the handling of the proposal through OMB. Copies were sent immediately. 16. Pat Yack, in the office of. Representative Alan Steelman (it. , Texas), called and asked if the Agency had any non--sensitive information which can be given to Mr. Steelman concerning the world grain situation. I discussed this with OCI, and a paper is being prepared to be used for official purposes only, 17. I Ed Terrar, on the personal staff of Representat Bob Wilson (R. Calif. ), called and asked for assistance in the handling of a requ( from a major in the U. S. Army who is a close friend of Mr. Wilson and a former Green Beret in Vietnam. who had a list of about 70 Vietnamese military and civilia whom he asked be given assistance in evacuation. from. C. 5724a(a)(3) and (4) to liberalize conditions under which an employee may be entitled to subsistence expenses while occupying temporary quarters; and liberalizing code provisions which authorize reimbursement for the expenses of sale and purchase of a residence upon the transfer of an employee. No written response is required. 2. At Mr. Cary's instruction, called Russ Rourke in the White House regarding H. Res. 400. I inquired whether his office had been requested for comments by the No 7 Committee on intevnatinnal xzPlaFinns and what the Administration's position was.. I. told. him we had some special problems with this because of the section of our charter which exempted the Agency from the provision of any law requiring, disclosure of the names, numbers, or functions of personnel. Rourke was quite sympathetic to our problem but said he believed this resolution was being handled by the office of Phil Buchen, Counsel to the President. He then suggested I call Rod Hills, whom he said had been newly appointed as deputy to Mr. Buchen and who would know what action was being taken. I subse- quently called Hills at the number Rourke provided but he was tied up and said he would get back to me this afternoon. 3. I told Henderson that we would not be prepared to talk on the evacuation program which was not within. our jurisdiction but that we would be pleased to provide an intelligence briefing, on the military situation in South Vietnam, not as part of a presentation by State and DIA, but as a separate input suggesting that we could lead off with our briefing and then leave. We settled on 10:00 Thursday, 10 April for the briefing. He mentioned that Secretary Kissinger was scheduled to appear before the Subcommittee on 11 April and Secretary Schlesinger later in the month. 6. I Jack Marsh, Counselor to the President, called late in the day to say he had received calls today from two congressional offices (Representative John McCollister and Senator Jesse Helms) conveying reports that missionaries are being advised to evacuate Saigon by boat and that people are going about the streets in Saigon giving this advice over loudspeakers. Marsh said if there was any truth to these reports he would like to be advised. She gave me the name in strict confidence. I told her she really should contact State but I would check to see what our people had to say. I called her back and told her that I had checked here and we just did not know if the woman's name was on the list for evacuation, but we could only assume that because of the work she was doing her name in all probability would be on the list. Called Herb Roback, who is now a staff member of the House Armed Services Committee, regarding the call John Warner had received from Tom Greene. Roback said he did not know Greene' personally but had heard of him and he said we might find ourselves in a bit: of difficulty with him. Roback, as usual, appreciated our dilemma. He said he thought we might find an analogy in what he thought was a similar situation involving the Defense Department and C-5A.cost records on overruns. He suggested that we might want to call Gordon Niederlander in DOD to see how he has handled problems of this sort. I discussed this with Warner later who said Defense has specific regulations covering its actions in matters of this sort and pointed out as a matter of fact their situation is quite different from the one we are now working on. 11. I 1 Tom Greene, who said he is Representative John Moss' Special Counsel for the House Subcommittee ot-1 Investigations, for Interstate Commerce, called me this afternoon indicating that Moss was looking into SEC problems. , Greene indicated he had been briefed byM.r. Loomis of SEC and had been given my name. He said Moss was most anxious to get the facts on this and wanted to know what CIA authority existed which could override SEC law and regulations. As I attempted to think about explaining this, it- was clear this could not be done by telephone.
