SUBJECT: Response to Senator Kennedy's Letter on Electronic
Surveillance

1. A proposed response to Senator Kennedy's inquiry is attached at
Tab A for your signature. Both the Legislative Counsel and I believe it is
an acceptable alternative to answering the Senator's questions fully or to
providing an incomplete answer. --
2. The Legislative Counsel has received information which indicates
that Senator Kennedy's bill on electronic surveillance (S. 743) will be
referred to Senator McClellan's Subcommittee on Criminal Laws and Procedure
and not Senator Kennedy's Subcommittee on Administrative Practice and
Procedure. While this would not divert Senator Kennedy's subcommittee
of jurisdiction over what Federal agencies do in the area of electronic sur-
veillance, it hopefully %ciill end further inquiries from him by placing the
primary responsibility for the matter elsewhere.
3. You will note that Senator Kennedy's letter requests a response by
2 May as he intends to begin' hearings on '6 May.
