SUMMARY OF H.R. 169 AND H.R. 12039
Both H.R. 169 and H.R. 12039 amend the Privacy Act by:
(1) striking out CIA's name exemption in section (j) (1);
(2) striking out the Secret Service exemption in section (k) (3); and
(3) altering section 3 (d) (2) (B) (i) to permit an individual to request
amendment or deletion of records pertaining to him which are illegally
maintained. (This would be in addition to an individual's existing right
to request amendment of inaccurate, irrelevant, untimely or incomplete
records.)
In addition, H.R. 12039 would require every agency to inform each
person who was--
(a) the subject of any warrantless or non-consensual electronic
or.mail surveillance or surreptitious entry;
(b) the subject of a file or named in an index in connection with the
so-called CHAOS, COINTELPRO, and "Special Service Staff" programs.
