SUBJECT : Garnishment Issue
1. I will be gone on leave the first week after your return so I
thought I would bring you up to date on the garnishment issue. Early in
the first week you were gone, I spoke with Russ Chapin at Justice, and
Naomi Sweeney and Chris Aughney at OMB. Russ said they had submitted
a proposal for clarifying legislation to OMB and that it had been returned to
Justice for some revision. It will be resubmitted shortly. He informed me,
as did Sweeney, that this package would be widely disseminated by OMB,
probably on a priority basis, and that the Agency would get a chance to
review this legislation. However, apparently it will not address any of our
particular concerns. OLC will handle the comments on the legislation, but
I will be in touch with you when we receive Justice's proposal.
2. The regulations are apparently moving along fairly slowly.
Chris Aughney said they were considering a major revision of the Executive
Order which delegated the responsibility for writing regulations to the Civil
Service Commission. Apparently OMB is considering putting more guidelines
in the Executive Order. Chris guaranteed me that we will have the opportunity
to comment on the revised Executive Order (if they go that route) and on the
regulations. She put both my name and your name on her list of those whom
she keeps informed of any significant developments in this area. OGC will no
doubt get the action on any request for comments on the proposed regulations,
but I would appreciate your notifying me and sending a copy of the proposed
regulations and the Agency's comments.
