We have reviewed House Resolution 11439 and favor its adoption. 2. This bill would make it possible for the surviving spouse of an employee to regain health insurance cover age under the Federal Employe ES Health Benefits Program in the event of restoration of a survivor annuity previously terminated because of remar- riage. Such a restoration of survivor annuity is currently provided for by law when the remarriage is terminated by death, annulment, or divorce. Unfortunately, however, the surviving spouse is prevented from concurrently regaining health insurance coverage because there is no provision for an annuitant to change his or her health benefits enrollment from not enrolled to enrolled. To amend title 5, United States Code, to restore eligibility for health benefits coverage to certain individuals whose survivor annuities are restored. Be it enacted by the Senate and House of Representa- tives of the United States of America in Congress assembled. 3 That (a) section 8908 of title 5, -United States Code, is amended- (1) by inserting " (a) " immediately before "An employee"; (2) by adding at the end thereof the following new subsection: Approved For Release 2006/02/07 : CIA-RDP77M00144RO01100210034-3 Approved For Release 2006/02/07 : CIA-RDP77M00144RO0110021r0034,3' 2 1 (b) A surviving spouse whose survivor annuity under 2 this title was terminated because of remarriage and is later :3 restored may, under such regulations as the Civil Service 4 Commission may prescribe, enroll in a health benefits plan described by section 8903 of this title if such spouse was cov- ered by any such plan immediately before such annuity was 7 terminated."; and (3) in the section caption, by striking out "em- 9 ployee" and inserting in lieu thereof "employee em- 10 ployees and survivor annuitants". 11 (b) The item relating to section 8908 appearing in the 12 analysis of chapter 89 of title 5, United States Code, is 13 amended to read as follows : "8908. Coverage of restored employees and survivor aniiltitants.". 14 SEC. 2. The amendments made by the first section of this 15 Act shall take effect on October 1, 1976, or on the date of the r 16 enactment of this Act, whichever date is later. Such amend- meats shall apply with respect to individuals whose survivor annuities are restored before, on, or after such date.
