A-34 Transmittal Memorandum No. 1 TO THE HEA16 OF EXECUTIVE D PA +1TS AND ESTABLISHMENTS SUBJECT: Instructions Relating to Apportionments and Reports on Budget Status Attached are revised pages which should be substituted for the comparable pages of Bureau of the Budget Circular No. A-34, dated July 1957. Changes are as follows: Section 32. Instructions with respect to requests for apportion- ment or reapportionment on a basis which indicates the need for a sup- plemental appropriation have been revised to require that: (1) a notation to that effect be entered on the form, and (2) such requests be accompanied by three copies of the determination of the agency head which is made pursuant to subsection (e) (1) of section 3679, Revised Statutes, as amended (31 U. S. C. 665). These changes result from section 1401 of the Supplemental Appro- priation Act, 1958 (Public law 85-170, approved August 28, 1957) which amended that subsection. The amendment added a prohibition against the requesting of apportionments or reapportionments which indicate the necessity for a deficiency or supplemental estimate except on the deter- mination of the agency head that such action is within the exceptions expressly set out in the law. Section 3679 of the Revised Statutes, as amended, permits such action when necessary because of (A) any laws enacted subsequent to the transmission to the Congress of the estimates for an appropriation which require expenditures beyond administrative control; or (B) emergencies involving the safety of human life, the protection of property, or the immediate welfare of individuals in cases where an appropriation has been made to enable the United States to make payment of, or contributions toward, sums which are required to be paid to individuals either in specific amounts fixed by law or in accordance with formulae prescribed by law. In addition, section 210 of the General Government Matters Appro- priation Act, 1958 (71 Stat. 55) permits such apportionment action to the extent necessary to permit payment of wage board pay increases.
