Associate General Counsel
SUBJECT Draft Submission to the Counsel.
to the President
1. Per our 23 April conversation, I think it would
be a great error to make any submission to the Counsel
to the President broken out by Directorate. If at all
possible, we should avoid having any mode of internal
structure or organization enshrined in statute or
Executive Order. This approach would impart a rigidity
that could severely hamper the ability of this.DCI or
his successor(s) to make internal reorganizations as
dictated by changing needs, circumstances, etc.
2. With this thought in mind, attached is a rough
cut at listing the Agency's overall functions by
functional. category without any reference to internal
organization or the assignment of internal responsibilities.

FUNCTIONS OF THE AGENCY
I. COLLECTION
A. Collect foreign intelligence -- clandestinely
and overtly -- on political, military, economic,
scientific and technical, foreign policy,
narcotics and terrorist matters about countries
other than the U.S.; i.e., on all matters
capable of affecting the security of the
United States or germane to the conduct of
U.S. foreign policy. The focus of Agency
activities in this sphere is the collection of
foreign intelligence. Most of that intelligence
will be collected abroad, but the Agency needs
the right to perform within the United States
such actions as directly relate to or provide
essential support for its foreign intelligence
mission. Also, to perform that mission, the
Agency needs the right to do the following:

B. Collect foreign intelligence (as outlined above)
via technical devices.

II. PRODUCTION
A. Analyze all-source data and produce finished
substantive intelligence on subjects affecting
the national security of the United States or
germane to the conduct of U.S. foreign policy.
1. Produce daily current intelligence
publications.
2. Conduct periodic studies in greater depth
on foreign economic, political, military,
scientific and technical, and foreign
policy matters.
3. Provide continuing substantive support
to senior policy officials.
4. Furnish inputs to national intelligence
products designed to meet the needs of
the foreign policy decision makers.

6. Maintain extensive reference material
including files on U.S. and foreign
activities.
III. COUNTERINTELLIGENCE
A. Conduct operations to neutralize the effectiveness
of' foreign intelligence activities against U.S.
intelligence efforts (overseas and domestic).

IV. COVERT ACTION
A. Conduct psychological, political, economic or
paramilitary activities in support of U.S. foreign
policy decisions.

V. SUPPORT
Provide administrative and technical support for all
intelligence, organizational and related activities.

1. Conduct physical examinations of applicants
for employment and maintain medical files
on applicants and employees.

C. Training
1. Establish training bases, foreign and
domestic.
2. Conduct tradecraft training within the U.S.
3. Train selected foreign intelligence
personnel in the U.S.
4. Train federal officers in technical
expertise, i.e., bomb disposal.
D. Logistics
E. Communications
1. Provide communications services, both
domestic and worldwide.
F. Personnel
1. Maintain files on Agency personnel,
applicants and employees of contractors.

VI. MISCELLANEOUS
B. Documents related to intelligence sources and
methods will not be subject to the Freedom of
Information Act. Files maintained by the CIA
shall not be subject to the Privacy Act.
C. Some statutory clarification of the scope of
the DCI's responsibility for protecting the U.S.
Government's intelligence sources and methods
and clarification of the actions he is authorized
to take or commission in the discharge of that
responsibility.

This paper is a draft of the Agency functions.
It is the first cut of a paper for submission to the
Counsel to the President. We understand it is to
serve as a foundation for a new Agency Charter,
Would you please let me have any additions you
may have by noon Thursday, 24 ApriL You may
call in your suggestions on R9419. The language
in this draft is not to be considered for the proposed
legislation. At this time, w e want to list all the
Agency functions to be sure they will be covered.
