As we discussed on the telephone yesterday, it would be
very helpful to the Subcommittee in its consideration
of S. 796 and S. 3297 if you could provide answers to the
following questions:
(1) Please give examples of "a matter pertaining to
a military or foreign affairs function of the United
States" which would become subject to public disclosure
by virtue of S. 796 sec. 2(1) but which is not already
subject to public disclosure under 5 U.S.C.A. sec.
552(b) (Supp. 1976). Please give enough examples
arify the range and importance of the increase
in public disclosure provided by S. 796. In these
examples, you may assume that the present standards
of classification apply and that "rule" is defined by
the current 5 U.S.C. sec. 551(4) (1970).
(2) If S. 796 sec. 2(1) significantly expands the class
of agency matters subject to public disclosure, why
cannot further classification by the President prevent
disclosure of any material whose disclosure would
adversely affect the agency's operations.

(3) Please give your opinion whether and to what extent
S. 796 sec. 2(1) would lessen the Director's authority to
prevent public disclosure of sensitive material under
50 U.S.C. sec. 403 (1970).
