Chapter 3 of part III of the Foreign Assist- 3 ance Act of 1961, as amended by sections 17 (a) and 18 of 4 this Act, is further amended by adding at the end thereof 5 the following new section : 6 "SEC. 661. LIMITATIONS UPON INTELLIGENCE Ac- 7 TIVITIES.- (a) No funds appropriated under the authority 8 of this or any other Act may be expended by or on behalf 9 of the Central Intelligence Agency or any other agency of Amdt. Notwithstanding the fore- 4 going limitation, the .President may authorize and direct that 5 any covert action operation be resumed, or that any other 6 covert action operation be initiated, and funds may be ex- pended therefor, if lie (1) finds that such operation is vital to the -defense of the United States, and (2) transmits a report of his finding, together with a detailed description of the na- ture and the scope of such operation, to any joint committee of Congress, or any committee of either House of Congress, having jurisdiction to monitor and review the intelligence 13 activities of the United States Government. 14 " (b) Notwithstanding the provisions of subsection (a.) of 15 this section, the President may authorize and direct the con- 16 duct of such covert action operations as he deems of im- 17 mediate need and urgency during military operations 114i- 1.8 tiated by the United States under a declaration of war by 19 Congress or an exercise of powers by the President under 20 the war powers resolution (Public Law 93-148) .".
