1. At the Director's morning meeting, raised the question of Assistant
Attorney General Emriierglickrs statement to the court in the International
Oil Cartel case (transcript of argument pp. 849, 850) that there had been
established a "mechanism" involving cooperation of the Department of Justice,
CIA, Defense, and State, to protect the national interest in reaching
decisions as to the use of documents. I also called attention to his state-
ment "if the court wants to be reassured I can offer a conference with Mr.
Allen Dulles." DCI said HH as to the latter and later D/DCI explained that
Emmerglick must have been alluding to NSC Senior Staff consideration of the
problem a while back and also trying to pull leg. An leaving 25X1 A9a
this pretty much to the General Counsel's Office and ass-Lune D/DCI will keep
them and me informed of any action he takes as a member of the NSC Senior
Staff,
2. Also at the meeting, raised the question of clearing Cabot Lodge for
Special in view of his appointment, by Eisenhower, as chief liaison man with
National Security Agency. D/DCI said leave that to one of the major departments.
I also called attention to the desirability of making available to Senator
25X1 A2gLodge a copy of DCI had no comment. A final suggestion that
DCI might care to invite Lodge to an IAC meeting was not favorably received.
3. Attended 0/NE Board Meeting to consider draft of NIE-40, "Consequences
of Loss of Western Europe to USSR." It was the consensus of the meeting that
major assumptions and limitations on the estimate rendered it a rather futile
exercise. Specifically, the assumptionsthat there would be no destruction and
that the Soviet would not systematically loot the Western European Plant, while
at the same time preparing for an invasion,are extremely unrealistic. Furthermore
the two year limitation makes the estimate useless in as far as long term
considerations are concerned. It was pointed out that the estimate was originally
laid on by the board and strongly backed by DCI because of the light it might
throw on USSR's intentions. That is to say the amount they might be tempted
by such a rich prize lying helpless before them; and, of course, this condition
has been radically altered in the period r49-152. It was agreed that the
Secretary of the board should notify the other IAC agencies of this thinking and
ask their views on the desirability of abandoning 40 as an Estimate and instead
circulating to appropriate offices the EIC contributions. Acting DD/I under-
took to inform DCI of this.
