Legal Authority for Funding ICS and NFIB
1. Mr. Snodgrass of the House Appropriations Committee Staff
today orgally requested a memorandum be provided to the HAC on the
legal authority for the funding of the Intelligence Community Staff
and the USIB/NFIB.
2. He requested a brief memorandum setting forth the citation
or other specific legal basis, followed by "an explanation in
layman's terms.."
3. The legal authority for the existence of NDIB was provided-
by specific provision in NSCID No. 1, and for the NFIB it is in
the general authority stated in Executive Order. 11905, Section 3 (d)
(1) (xiv) which provides that the DCI shall:
"Establish such committees of collectors,
producers and users of intelligence to assist
in his conduct of his responsibilties as he
deems appropriate."
4. No mention of an Intelligence Community Staff appeared
in any of the NSCIDs, but E.O. 11905, Section 3 (h) (3) states:
"(3) The CFI shall be supported by the Intelli-
gence Community Staff headed by the Deputy to
the Director of Central Intelligence for the
Intelligence Community."
5. As you are aware, the ICS and the NFIB Secretariat are
carried in the CIA budget, so I am assuming that the query as to
the "legal authority for the funding" relates to by what authority
CIA pays the bills.
6. We have been asked to respond by the end of the week.
Since this is a legal problem your comments will'be our response.
We would appreciate a reply by COB on Thursday, 27 May.
