SUBJECT: Unclassified Omnibus NSCID

1. The outstanding question raised by Senator McClellan
with respect to NSCIDs apparently can be satisfied by an unclassified
statement of functions and responsibilities which has been prepared.
2. In the time allotted, we have been unable to do a complete
and detailed review of the substantive information contained in your
draft but if this goes forward ?undoubtedl the s ecific rovisions can
be looked at a ain.
3. We believe there are a number of reasons for not going
forward with this. The practical purpose of gaining coordination from
the various departments and review in the White House would, undoubtedly,
be time consuming. Additionally, however, we are concerned about the
timing. There are numerous bills introduced on the Hill to modify the
Agency charter. Some of these are extreme and could cause serious
difficulties for the Administration and the Agency. However, Senator
Stennis is actively pursuing amending legislation in a responsible fashion
and the Nedzi Subcommittee clearly is going to do likewise. This raises
the question that if an unclassified NSCID appears there will, undoubtedly,
be raised the question of why the "Agency charter" should not be placed
in legislation. Clearly such a result would be undesirable.

SUBJECT Unclassified Omnibus NSCID
1. Pursuant to your request of 17 October 1973, we
have reviewed the draft unclassified NSCID and concur in
its release on an unclassified basis.
2. We have noted that the first page after Tab C
states that there is "no reference to nuclear information
in unclassified NSCID". Paragraph 8a of the Omnibus NSCID
mentions national technical means of verification as
related to...the limited nuclear test ban.
3. Please advise if any additional information
is desired.
