These regulations were drafted In accordance with Article 14 of the "Regulations Concerning the Control of Wireless Telegraphic Equipment" issued by the Minis- try of Public Security of the Central Feople's Government on 5 August 1 51. The full texts of the two regulations foilow:7 Supplementary Regulations Concerning the Control of Wireless Telegraphic Equip- ment in Shanghai, issued by Public Security Bureau, Shanghai People's Govern- ment Article 1. These regulations have been issued in accordance with the provisions set forth in Article l=b oi' t:ie "Reg,ulations Concerning the Control of Wireless Telegraphic Equiirment" issued by the Ministry of Public Security, Central People's Government. Article 2. These regulations are supplementary to those issued by the Central People's Government and are to be enforced in Shanghai for the control of wireless telegraphic equipment. Article 3. All manufacturers and distributors of telegraphic equipment in Shanghai must apply to this bureau for permission to operate their establish- ments, as follows. a. Any person who plans to engage in the manufacture of telegraphic equipment must first obtain and fill out a registration form in duplicate for submission to this bureau. When approval is obtained, the applicant must then register his establishment with the Industry and Commerce Bureau; after which, he will be permitted to start operations. b. Any person now engaged in the manufacture of telegraphic equip- ment shall be required to submit a request to continue operation, as well as an equipment registration form in duplicate to this bureau within one month after these regulations are put into effect. c. An establishment with branch shops or offices must apply for a separate permit for each branch shop or office. d. The permit to operate mutt be displayed in a prominent place in the establishment to facilitate inspection. Article 4. Any establishment which plans to change its name, manager, or stockholders, or to enlarge, move, or terminate its business must apply to this bureau for an approval 7 days prior to the date on which such _!ert is to take place. Any establishment planning to move or terminate its business must submit its plan for disposing of its inventory qnd equipment to this bureau. Article 5. The purchase or repair of wireless telegraphic equipment shall be governed as follows: a. Any organization or group desiring to purchase or repair wireless equipment must first obtain from this bureau a purchase certificate which lists the name, quantity, and the use to which the equipment will be made. (organ- izations and groups from outside Shanghai must present similar purchase cer- tificates issued by their respective Public Security Bureaus.) The certificate to be issued shall be valid only at an authorized establishment. b. A written request containing pertinent data, such as the names, quantity, etc., must be submitted to this bureau for any transaction to be carried out between the manufacturers and the distributors. A purchaser from outside Shanghai must have a permit issued by the Public Security Bureau from his area. c,. Any local resident planning to purchase a radio or radio spare parts which can be used as wireless telegraphic: transmitting equipment must first obtain a permit from this bureau. Tree permit to be issued will be valid only at an authorized establishment licensed to sell such goods. 1. nonresi- dent of Shanghai must first present a purchase permit issued by the Public Security Bureau of his area before he will be granted a purchase permit by this bureau. d. All manufacturers and distributors shall be required to submit all purchase permits received from the purchasers, together with a monthly equipment production and sales report in duplicate, to this bureau by the 5th of each month, e. The production and sales report to be submitted to this bureau by the manufacturers and distributors must be accompanied by a list of the names, professions, and addresses of all the purchasers of any articles listed in Item 9 of the "Regulations Concerning r,r.;trot of Wireless Telegraphic Equip- ment" issued by the Central People's Government. Article 6. For the continued possession of wireless equip- ment which could be used for transmitting purposes, a person shall be required to obtain the approval of this bureau. Unless approved, this type of equip- ment may not be sold or exchanged privately. Article 7. To import wireless telegraphic equipment, a person must not only apply for an import permit from the Foreign Trade Control Bureau, but also must submit a request to this bureau for the inspection of such equipment. Transshipment of any wireless telegraphic equipment must be first approved by this bureau.' Article 8. For the transport of any wireless telegraphic equipment, a transport certificate must be obtained from this bureau. Procedures to be followed are: a. Manufacturers and distributors must complete an equipment trans- port registration form and apply to this bureau for a transport certificate. b. Persons not engaged in any business must apply directly to this bureau for a transport certificate. c. A local resident planning to move a radio receiver must apply in person to this bureau for a transport certificate. Article 9. Any person who violates these regulations shall be punished in accordance with law and in accordance with the degree of the offense. 1. The phrase, "Condensers of more than 600 volts," in Item 4 of the regulations issued by the Central People's Government shall be revised to read, "Condensers of more than 1,000 volts." 2. The phase, "Electric generators which generate more than 150 volts," in Item 7 of the regulations issued by the Central People's Government shall be revised to read, "Direct current electric generators which generate more than 150 volts." 3. Wireless telegraphic transmitting equipment listed in Item I through Item 8 of the regulations issued by the Central People's Government shall come under these regulations. The purchase of any loud-speaker parts listed in Item 1 through 8 of the above-mentioned regulations shall require an approval and a certificate. Regulations Concerning the Control of Wireless Telegraphic Equipment, issued by the Ministry of Public Securit} Central People's Government, 5 August 151 Article 1. Unless governed by other regulations, any establishment, whether a publicly or privately owned enterprise or a corporaticn, engaged in the repair or manufacture of wireless telegraphic equipment shall be governed b3 these regulations. Everyone, including foreigners, as well as those not er_..ged in any business shall be governed by these regulations. Article 2. Anyone who is engaged in the wireless telegraphic equipment business shall be required to register with the public security bureau of a municipal or hsien people's government. Complete and submit l a ist of the names of the manager, share- holders, and workers, as well as a diagram describing the buildings and instal- lations. (Peddlers engaged in selling and repairing wireless telegraphic equip- menr, need not comply with the above.) c. After the Public Security Bureau completes the inspection and issues a special business operation permit, he shall apply for a business op- eration lacedbe by registering with the Industry and Commerce Bureau. Article 3. Approval by the Public Security Bureau shall be required of all manufacturers and distributors before changing the name of the business, manager, or stockholders, and before planning any expansion, moving, or term- ination of business. Article 4. All manufacturers and distributors shall be required to sub- mit an equipment production and a sales report in duplicate to the Public Security Bureau or its branch office each month. Article 5. Any purchaser of wireless telegraphic transmitting equipment and receivers shall be required to present credentials from an organization to which he belongs. He must fill out a purchase request form giving details re- garding the use, type, name, and quantity of the equipment to be purchased. A purchase certificate must be obtained from the Public Security Bureau before any transactions can be made. Distributors shall be required to forward all purchase certificates collected during the month to the Public Security Bureau or its branch office, together with the equipment production and sales reports. Any transaction between business firms mu't be made in accordance with the above procedures. Article 6. Anyone who sends transmitting equipment or receivers to a business firm for repair must first obtain a repair hermit from the Public Security Bureau. No repairs shall bu undertaken by any firm without a repair permit. All -epair permits collected by a firm must be forwarded to the Public Security Bureau each month with the equipment production and sale re- port. Article 7. Any person who owns wireless telegraphic transmitting equip- ment must register with the Public Security Bureau or its branch office. Article 8. A purchaser of any of the equipment listed in Item 9 need not comply with Articles 5, 6, and 7. Authorized firms shall be required to show their monthly sales on the equipment production and bales report sub- mitted to the Public Security Bureau or its branch office each month. Article Tile import or transshipment of wireless telegraphic equip- ment must not only he approved and inspected by the Public Security Bureau but must also be accompanied by an impo t or transshipment permit issued by the Foreign Trade Control Bureau. Article 10. Transshipment of any wireless telegraphic equipment must be approved by the Public Security Bureau and must be accompanied by a transport certificate issued by this bureau. Article 11. A reward ahall be given to the informer and if necessary, his identity will be ,arefully safeguarded. Article 12. Anyone found guilty of violating these regulations shall be punished in accurdance with lav, the punishment to be mated out according to the offense. Article 13. When it is requested by a public security officer, a manu- facturer or a distributor must present his operating permit. A public security officer shall be vested with the power to arrest anyone who is unable to show such operating permit. Article 14. The Departments of Public Security of the various administra- tive areas shall be authorized to issue supplementary regulations to these regu- lations. Any supplementary regulations issued by a provincial, municipal, or hsien public security bureau must be approved by the Department of Public Secur- ity of an administrative area. Article 15. These regulations have been approved by the Committee of Political and Legal Affairs, Government Administ-ation Council, Central People's Government.
