Ms. McNeeley will call me back. 17. (Unclassified -JMD) LIAISON Called Pat Butler, appointment .secretary to Senator Ted Stevens (D. , Alaska), to arrange a courtesy call meeting between the Senator and Ambassador Carlucci. Ms. Butler said the Senator will not be back in town until 18 January and he has to approve all appointments. She said she will call me on 19 January and advise me when the Senator can meet with the Ambassador. 18. GLC) LIAISON Called John Ahearne, Department o~ Energy, by way of follow-up to a call he had placed to Jack Blake, A/DDCI. In response to his question, I told him we had briefed Representative Morris'Udall (D., Ariz.) on NUMEC on 26 August 1977. We talked about the response which DOE would make to an inquiry from Mr. Udall for copies of our NUMEC documents in their possession. I suggested (as I have done with several other DOE representatives) that they indicate that in accordance with the third agency rule, any request for documents which DOE has obtained from CIA. should be addressed to the Agency. Ahearne (as other DOE repre- sentatives) expressed a reluctance to make any reference to the third agency rule. They feel that referring to this rule is tantamount to invoking executive privilege. He said they are merely indicating to Mr. Udall that NUMEC documents in their possession include some CIA material and that requests for access to those materials should be addressed to the Agency.
